AN ACT 1 Amending the act of July 29, 1953 (P.L.1435, No.411), entitled 2 "An act relating to the more effective treatment of persons 3 convicted of crime or committed as defective delinquents; 4 creating in the Department of Justice correctional diagnostic 5 and classification centers; providing for the diagnosis and 6 classification of persons sentenced or committed by the 7 courts to a State institution; fixing the responsibility for 8 costs of transportation and maintenance of such persons; 9 prescribing duties of the courts and the powers and duties of 10 the Department of Justice relative thereto; making civil and 11 criminal laws applicable to penitentiaries and persons 12 therein or responsible therefor applicable in the case of the 13 said institutions," providing for the treatment of sex 14 offenders; and making an editorial change. 15 The General Assembly of the Commonwealth of Pennsylvania 16 hereby enacts as follows: 17 Section 1. The title of the act of July 29, 1953 (P.L.1435, 18 No.411), entitled "An act relating to the more effective 19 treatment of persons convicted of crime or committed as 20 defective delinquents; creating in the Department of Justice 21 correctional diagnostic and classification centers; providing 22 for the diagnosis and classification of persons sentenced or 23 committed by the courts to a State institution; fixing the
1 responsibility for costs of transportation and maintenance of 2 such persons; prescribing duties of the courts and the powers 3 and duties of the Department of Justice relative thereto; making 4 civil and criminal laws applicable to penitentiaries and persons 5 therein or responsible therefor applicable in the case of the 6 said institutions," is amended to read: 7 AN ACT 8 Relating to the more effective treatment of persons convicted of 9 crime or committed as defective delinquents; creating in the 10 Department of [Justice] Corrections correctional diagnostic 11 and classification centers; providing for the diagnosis and 12 classification of persons sentenced or committed by the 13 courts to a State institution; providing for the treatment of 14 certain sex offenders; fixing the responsibility for costs of 15 transportation and maintenance of such persons; prescribing 16 duties of the courts and the powers and duties of the 17 Department of [Justice] Corrections relative thereto; making 18 civil and criminal laws applicable to penitentiaries and 19 persons therein or responsible therefor applicable in the 20 case of the said institutions. 21 Section 2. The act is amended by adding a section to read: 22 Section 5.1. The Secretary of Corrections shall provide for 23 the treatment of persons sentenced under 42 Pa.C.S. Ch. 97 24 Subch. H (relating to sentencing of sex offenders) at diagnostic 25 and classification centers. 26 Section 3. This act shall take effect in 60 days. C4L61WMB/19870H0992B1094 - 2 -
