                                     AN ACT

     1  Requiring the inspection of used motor vehicles prior to sale at
     2     retail and a one-year warranty upon all essential parts
     3     thereof.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Used Motor
     8  Vehicle Sales Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Dealer."  A person engaged in the business of selling used
    14  motor vehicles at retail.
    15     "Sale."  A sale at retail to a consumer.
    16     "Used motor vehicle."  A motor vehicle having an original
    17  title and which is either a passenger car or a truck of a
    18  registered gross weight of 5,000 pounds or less, as defined in

     1  Title 75 of the Pennsylvania Consolidated Statutes (relating to
     2  vehicles).
     3  Section 3.  Inspection.
     4     A dealer shall thoroughly inspect a used motor vehicle prior
     5  to its sale. A report of this inspection shall be given to any
     6  prospective buyer.
     7  Section 4.  Warranty.
     8     A dealer shall give an express written one-year warranty for
     9  all of the essential parts of a used motor vehicle upon sale.
    10  This warranty shall be in addition to any other warranties given
    11  by the manufacturer which may be in effect and any other express
    12  or implied warranties provided for by law, including, but not
    13  limited to, Title 13 of the Pennsylvania Consolidated Statutes
    14  (relating to commercial code).
    15  Section 5.  Effective date.
    16     This act shall take effect in 90 days.
