AN ACT
1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
2 act concerning townships of the second class; and amending,
3 revising, consolidating, and changing the law relating
4 thereto," further providing for the penalty for destroying,
5 removing, injuring or defacing signs.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Section 1161 of the act of May 1, 1933 (P.L.103,
9 No.69), known as The Second Class Township Code, reenacted and
10 amended July 10, 1947 (P.L.1481, No.567) and amended May 17,
11 1972 (P.L.298, No.76), is amended to read:
12 Section 1161. Penalty for Destroying, Et Cetera.--It shall
13 be unlawful for any person to wilfully destroy, remove, injure,
14 or deface any guidepost or sign or index board LEGALLY erected <--
15 upon or near any public street, road, or bridge by the
1 supervisors, or by any club, association, or other organized 2 body for the direction, guidance, or safety of travelers. It 3 shall also be unlawful for any person to wilfully destroy, 4 remove, injure or deface any temporary traffic-control device 5 LEGALLY erected for the purpose of enhancing traffic or worker <-- 6 safety in a construction or maintenance work zone, including, 7 but not limited to, cones, batons, barrels, barricades, signs, 8 sign trucks, arrow boards or other devices specified in a 9 traffic safety plan approved by the township or the Department 10 of Transportation. Any person violating this section shall, upon 11 conviction in a summary proceeding, be sentenced to pay a fine 12 of [not more than fifty dollars] not less than two hundred 13 dollars nor more than five hundred dollars for the first 14 offense, and a mandatory fine of five hundred dollars for the 15 second or any subsequent offense, with costs of prosecution, 16 together with the value of such sign so destroyed, removed or 17 defaced, and in default of such payment, shall be sentenced to 18 imprisonment of not more than ten days. All fines and moneys so 19 imposed and collected shall be paid to the township treasurer. 20 Section 2. This act shall take effect in 60 days. B2L73CHF/19870H0272B2910 - 2 -
