        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JUNE 22, 1987

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further providing for the penalty for destroying,
     5     removing, injuring or defacing signs.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1161 of the act of May 1, 1933 (P.L.103,
     9  No.69), known as The Second Class Township Code, reenacted and
    10  amended July 10, 1947 (P.L.1481, No.567) and amended May 17,
    11  1972 (P.L.298, No.76), is amended to read:
    12     Section 1161.  Penalty for Destroying, Et Cetera.--It shall
    13  be unlawful for any person to wilfully destroy, remove, injure,
    14  or deface any guidepost or sign or index board erected upon or
    15  near any public street, road, or bridge by the supervisors, or


     1  by any club, association, or other organized body for the
     2  direction, guidance, or safety of travelers. It shall also be
     3  unlawful for any person to wilfully destroy, remove, injure or
     4  deface any temporary traffic-control device erected for the
     5  purpose of enhancing traffic or worker safety in a construction
     6  or maintenance work zone, including, but not limited to, cones,
     7  batons, barrels, barricades, signs, sign trucks, arrow boards or
     8  other devices specified in a traffic safety plan approved by the
     9  township or the Department of Transportation. Any person
    10  violating this section shall, upon conviction in a summary
    11  proceeding, be sentenced to pay a fine of [not more than fifty]   <--
    12  five hundred dollars] NOT LESS THAN TWO HUNDRED DOLLARS NOR MORE  <--
    13  THAN FIVE HUNDRED DOLLARS FOR THE FIRST OFFENSE, AND A MANDATORY
    14  FINE OF FIVE HUNDRED DOLLARS FOR THE SECOND OR ANY SUBSEQUENT
    15  OFFENSE, with costs of prosecution, together with the value of
    16  such sign so destroyed, removed or defaced, and in default of
    17  such payment, shall be sentenced to imprisonment of not more
    18  than ten days. All fines and moneys so imposed and collected
    19  shall be paid to the township treasurer.
    20     Section 2.  This act shall take effect in 60 days.
