        AS AMENDED ON SECOND CONSIDERATION, IN SENATE, MARCH 22, 1988

                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, safeguarding the public from attack by exotic
     3     wildlife.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 2907, 2962(c), 2963(c) and 2964(c) of     <--
     7  Title 34 of the Pennsylvania Consolidated Statutes are amended
     8  to read:
     9  § 2907.  REPORTS.                                                 <--
    10     THE DIRECTOR MAY REQUIRE REPORTS FROM ANY PERMIT HOLDER,
    11  EXCEPT THAT NO REPORT MAY BE REQUIRED WITH RESPECT TO SPECIES OF
    12  FOX NOT INDIGENOUS TO THIS COMMONWEALTH. ANNUAL REPORTS SHALL BE
    13  DUE WITHIN 30 DAYS AFTER EXPIRATION OF THE PERMIT. THE DIRECTOR
    14  MAY DESIGNATE OTHER TIMES FOR REPORTS IF INFORMATION IS NEEDED
    15  BY THE COMMISSION FOR ITS OPERATIONS.
    16  § 2962.  Exotic wildlife dealer permits.

     1     (c)  Unlawful acts.--It is unlawful for any person to:
     2         (1)  Import into this Commonwealth, possess, buy, sell,
     3     locate or find for a fee, barter, donate, give away or
     4     otherwise dispose of more than one bird or one animal
     5     classified as exotic wildlife in any calendar year without
     6     first securing a permit issued under this section.
     7         (2)  Release exotic wildlife into the wild.
     8         (3)  Fail to exercise due care in safeguarding the public
     9     from attack by exotic wildlife.
    10         (4)  Recklessly engage in conduct which places or may
    11     place another person in danger of attack by exotic wildlife.

    13  § 2963.  Exotic wildlife possession permits.

    15     (c)  Unlawful acts.--It is unlawful for any person to:
    16         (1)  Possess, purchase or receive exotic wildlife,
    17     without first securing a permit to possess exotic wildlife
    18     issued under this section or regulations pertaining to this
    19     section.
    20         (2)  Release exotic wildlife into the wild.
    21         (3)  Fail to exercise due care in safeguarding the public
    22     from attack by exotic wildlife.
    23         (4)  Recklessly engage in conduct which places or may
    24     place another person in danger of attack by exotic wildlife.

    26  § 2964.  Menagerie permits.

    28     (c)  Unlawful acts.--It is unlawful to:
    29         (1)  Keep any wild bird or wild animal in captivity for
    30     public exhibition, or to have any wild bird or wild animal in

     1     custody or control for such purpose, without first securing a
     2     permit issued by the commission.
     3         (2)  Violate any of the provisions of this section or to
     4     release any bird or animal into the wild.
     5         (3)  Fail to exercise due care in safeguarding the public
     6     from attack by exotic wildlife.
     7         (4)  Recklessly engage in conduct which places or may
     8     place another person in danger of attack by exotic wildlife.

    10     Section 2.  This act shall take effect in 60 days.
