                                  A RESOLUTION

     1  Memorializing Congress to encourage cogeneration activities by
     2     gas utility holding company systems registered under the
     3     Public Utility Holding Company Act of 1935.

     4     WHEREAS, Section 11(b)(1) of the Public Utility Holding
     5  Company Act of 1935 authorizes limitations on the operations of
     6  a utility holding company registered under the act; and
     7     WHEREAS, Cogeneration would be encouraged if a utility
     8  holding company, registered under the Public Utility Holding
     9  Company Act of 1935, solely by reason of direct or indirect
    10  ownership of voting securities of one or more gas utility
    11  companies or any subsidiary company, could acquire or retain, in
    12  any geographic area, any interest in any qualifying cogeneration
    13  facilities; therefore be it
    14     RESOLVED, That the House of Representatives of the
    15  Commonwealth of Pennsylvania memorialize the Congress of the
    16  United States to consider and enact legislation that would
    17  encourage cogeneration by permitting the application of

     1  exemptions under and pursuant to section 210(e) of the Public
     2  Utility Regulatory Policies Act of 1978 from the Public Utility
     3  Holding Company Act of 1935 to a utility holding company
     4  registered under that act, solely by reason of direct or
     5  indirect ownership of voting securities of one or more gas
     6  utility companies, or any subsidiary company of such registered
     7  company, and permitting such companies to acquire or retain
     8  qualifying cogeneration facilities; and be it further
     9     RESOLVED, That copies of this resolution be transmitted to
    10  the presiding officers of each house of Congress and to each
    11  member of Congress from Pennsylvania.
