                                     AN ACT

     1  Amending the act of November 4, 1983 (P.L.217, No.63), entitled
     2     "An act establishing a program of limited pharmaceutical
     3     assistance for the elderly; granting powers to and imposing
     4     duties on the Department of Aging; establishing a payment
     5     system; making provisions for funding; providing for reports;
     6     and fixing penalties for violations of the pharmaceutical
     7     assistance program," extending the definition of "eligible
     8     claimant" to include certain disabled residents of
     9     Pennsylvania who are at least 62 years of age.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  The definition of "eligible claimant" in section
    13  3 of the act of November 4, 1983 (P.L.217, No.63), known as the
    14  Pharmaceutical Assistance Contract for the Elderly Act, is
    15  amended and the section is amended by adding a definition to
    16  read:
    17  Section 3.  Definitions.
    18     The following words and phrases when used in this act shall
    19  have the meanings given to them in this section unless the
    20  context clearly indicates otherwise:

     1     "Eligible claimant."  A resident of the Commonwealth 65 years
     2  of age and over or permanently disabled and 62 years of age and
     3  over, whose annual income is less than the maximum annual
     4  income, and who is not otherwise qualified for public assistance
     5  under the act of June 13, 1967 (P.L.31, No.21), known as the
     6  Public Welfare Code.

     8     "Permanently disabled."  Unable to engage in any work of a
     9  nature generally performed for remuneration or profit, involving
    10  the performance of significant physical or mental duties, or a
    11  combination of both, by reason of a medically diagnosed physical
    12  or mental impairment which is likely to continue indefinitely.

    14     Section 2.  This act shall take effect immediately.
