A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect; providing for a basis for payments of such 6 appropriations; and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums, or as much thereof as 17 may be necessary, are hereby appropriated to the Trustees of The 18 Pennsylvania State University for the fiscal year July 1, 1986, 19 to June 30, 1987, for the purposes and in the amounts as shown: 20 (1) For educational and general expenses and
1 for participation by a representative of the 2 institution, appointed by the chief executive 3 officer thereof, as a member of the Pennsylvania 4 Academic Commission on Technological Development, 5 a commission for interinstitutional communication 6 regarding technological innovation and development 7 and for dissemination of information on such 8 matters to the Pennsylvania business community and 9 others who may use such information for new 10 business and job development in Pennsylvania, such 11 commission to be composed of representatives of 12 every State-owned or State-related educational or 13 scientific institution receiving General Fund 14 assistance from the Commonwealth.................. $135,965,000 15 (2) For cost of research...................... 11,884,000 16 (3) For instruction - Doctor of Medicine only. 3,781,000 17 (4) For cost of agricultural research......... 14,144,000 18 (5) For cost of agricultural extension 19 services.......................................... 11,968,000 20 (6) For the cost of operating Elizabethtown 21 Hospital.......................................... 3,982,000 22 (7) To enhance recruitment and retention of 23 disadvantaged students............................ 200,000 24 Section 2. Payments to The Pennsylvania State University on 25 account of the appropriations for all items as provided in 26 section 1 shall be made on the basis of costs during the fiscal 27 year. 28 Section 3. If necessary, The Pennsylvania State University 29 may transfer funds among the appropriations listed in section 30 1(1), (2), (4) and (5): Provided, That the aggregate amount 19860H2509B3516 - 2 -
1 transferred into or out of each appropriation during the fiscal 2 year shall not exceed 5% of the amount specifically appropriated 3 for that purpose. 4 Section 4. (a) Payments to The Pennsylvania State 5 University of the appropriations provided in section 1 shall be 6 made monthly during the fiscal year. 7 (b) Such monthly payments shall be made in accordance with 8 the provisions of section 2 on the basis of estimated costs. The 9 estimate of costs shall be submitted by The Pennsylvania State 10 University to the Secretary of Education, the General Assembly 11 and the State Treasurer not later than 30 days prior to the date 12 on which such payment is to be made. 13 Section 5. Notwithstanding any provision of the General 14 Appropriation Act of 1986 relating to the payment of retirement 15 expenses, the Trustees of The Pennsylvania State University 16 shall make all required payments to the State Employees' 17 Retirement Fund from the funds appropriated pursuant to this 18 act. 19 Section 6. (a) The Pennsylvania State University shall 20 apply the moneys appropriated by this act only for such purposes 21 as are permitted in this act and shall at all times maintain 22 proper records showing the application of such moneys. Not later 23 than 120 days after the close of the fiscal year to which this 24 act relates, The Pennsylvania State University shall file with 25 the Secretary of Education, the General Assembly and the Auditor 26 General of the Commonwealth a statement setting forth the 27 amounts and purposes of all expenditures made from moneys 28 appropriated by this act and other university accounts during 29 said fiscal year, as provided in section 2, used as a basis for 30 receipt of any appropriation during said fiscal year. 19860H2509B3516 - 3 -
1 (b) Such statement of expenditures and costs shall be 2 reviewed by the Auditor General of the Commonwealth, and he 3 shall have the right, in respect to the moneys appropriated by 4 this act, to audit and disallow expenditures made for purposes 5 not permitted by this act and to cause such sums to be recovered 6 and paid by The Pennsylvania State University to the State 7 Treasurer. In respect to expenditures made by the university 8 from moneys other than those appropriated by this act, the 9 Auditor General shall have the right to review only and he shall 10 file annually with the General Assembly such information 11 concerning such expenditures as the General Assembly or any of 12 its committees may require. 13 Section 7. A report shall be submitted to the Governor and 14 the Appropriations and Education Committees of the Senate and 15 House of Representatives and shall include data for all programs 16 except the Doctor of Medicine program. The report, to be 17 submitted prior to September 1, 1987, shall cover the 12-month 18 period beginning with the summer term 1986 and shall include: 19 (1) The following counts and distributions for each term 20 during the period: 21 (i) The definitions and numbers of faculty members employed 22 full time, of faculty members employed part time, of full-time 23 students enrolled in graduate courses, of full-time students 24 enrolled in undergraduate courses, of part-time students 25 enrolled in graduate courses and of part-time students enrolled 26 in undergraduate courses. 27 (ii) The total numbers of undergraduate student credit 28 hours, divided into lower division and upper division course 29 levels, and of graduate student credit hours divided into three 30 course levels--master's, first professional and doctoral. 19860H2509B3516 - 4 -
1 (iii) The number of different courses scheduled by level of 2 instruction and the number of sections of individual instruction 3 scheduled by level of instruction, each further subdivided by 4 two-digit Classification of Instructional Program (CIP) 5 categories of instructional programs of higher education as 6 defined by the National Center for Education Statistics, United 7 States Department of Education. 8 (iv) The number of terms scheduled and the dates thereof. 9 (2) For the summer term and the following academic year in 10 total and for each two-digit CIP program category, a 11 classification of faculty members or other professional 12 employees by title, including: professor, associate professor, 13 assistant professor, instructor, lecturer, research associate, 14 librarian and academic administrator; faculty members or other 15 professional employees under each title to be subdivided by type 16 of assignment: teaching and nonteaching, and each such set of 17 faculty members or other professional employees to be further 18 subdivided by type of employment: full-time or part-time and the 19 following aggregates for each such subdivided classification: 20 (i) The number of faculty and other professional employees 21 and their full-time equivalence in instructional and 22 noninstructional functions. 23 (ii) The sum of credits assigned to undergraduate classroom 24 courses and the sum of credits assigned to graduate classroom 25 courses taught, divided into lower division, upper division, 26 master's, first professional and doctoral course levels. 27 (iii) The sum of credits assigned to undergraduate 28 individual instruction courses and the sum of credits assigned 29 to graduate individual instruction courses taught, divided into 30 lower division, upper division, master's, first professional and 19860H2509B3516 - 5 -
1 doctoral course levels. 2 (iv) The sum of undergraduate classroom student credit hours 3 and the sum of graduate classroom student credit hours 4 generated, divided into lower division, upper division, 5 master's, first professional and doctoral course levels. 6 (v) The sum of undergraduate individual instruction student 7 credit hours and the sum of graduate individual instruction 8 student credit hours generated, divided into lower division, 9 upper division, master's, first professional and doctoral course 10 levels. 11 (vi) The total salary paid for instructional functions and 12 for noninstructional functions and the amount of this salary 13 paid for each of these functions from university funds, Federal 14 funds and other funds. 15 (3) For each term of the period covered for each faculty 16 member employed full time identified by two-digit CIP program 17 category and title, the report shall contain an analysis of the 18 average hours per week spent in university-related activities, 19 stating specifically hours spent in undergraduate classroom 20 contact and graduate classroom contact, hours spent in 21 preparation, hours spent in research and hours spent in public 22 service. 23 Section 8. In addition to the requirements in section 7 24 relative to this appropriation, the report covering the 12-month 25 period beginning with the summer term 1986 shall include for all 26 programs of the university: 27 (1) Minimum number of credits required for a baccalaureate 28 degree and for a master's degree. 29 (2) Number of bachelor's degrees, master's degrees, first 30 professional degrees and doctoral degrees awarded in 1984, 1985, 19860H2509B3516 - 6 -
1 1986 and estimated 1987. 2 Section 9. The Pennsylvania State University shall provide 3 such information as may be necessary to carry out the provisions 4 of this act and in such form and manner as the Department of 5 Education shall prescribe. 6 Section 10. The Pennsylvania State University shall report 7 its revenues and expenditures and present its financial 8 statements required under the provisions of this act in 9 accordance with generally accepted accounting principles and 10 procedures for educational institutions as set forth in the 11 "Higher Education Finance Manual," United States Department of 12 Health, Education and Welfare (1975), with the exceptions set 13 forth in the "Commonwealth of Pennsylvania Budget Instructions 14 for State Related Universities, Phase I, Fiscal Year 1986-1987." 15 Credits granted for nontraditional programs such as CLEP, 16 lifelong learning, etc., including all related costs and 17 revenues thereof shall be excluded from the function of 18 "Instruction" and included under "Public Service." 19 Section 11.
