Effective date. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 PART I 16 GENERAL PROVISIONS 17 Section 101. Short title.--This act shall be known and may 18 be cited as the General Appropriation Act of 1986. 19 Section 102. Definitions.--The following words and phrases 20 when used in this act shall have the meanings given to them in 21 this section unless the context clearly indicates otherwise: 22 "Employees." Includes all directors, superintendents, bureau 23 or division chiefs, assistant directors, assistant 24 superintendents, assistant chiefs, experts, scientists, 25 engineers, surveyors, draftsmen, accountants, secretaries, 26 auditors, inspectors, examiners, analysts, statisticians, 27 marshals, clerks, stenographers, bookkeepers, messengers and 28 other assistants in any department, board or commission. 29 "Expenses" and "maintenance." Includes all printing, binding 30 and stationery, food and forage, materials and supplies, 19860H2508B3515 - 5 -
1 traveling expenses, training, motor vehicle supplies and 2 repairs, freight, express and cartage, postage, telephones and 3 telegraph rentals and toll charges, newspaper advertising and 4 notices, public advertising by or through any medium, fuel, 5 light, heat, power and water, minor construction and renovation, 6 repairs or reconstruction of equipment, buildings and 7 facilities, rent of real estate and equipment, premiums on 8 workmen's compensation, insurance premiums on policies of 9 liability insurance, insurance premiums on medical payment 10 insurance and surety bonds for volunteer workers, premiums on 11 employee group life insurance and employee and retired employee 12 group hospital and medical insurance, payment of Commonwealth 13 share of Social Security taxes and unemployment compensation 14 costs for State employees, the purchase of replacement or 15 additional equipment and machinery and all other incidental 16 costs and expenses, including payment to the Department of 17 General Services of mileage and other charges for the use of 18 automobiles and rental payments for permanently assigned 19 automobiles and of expenses or costs of services incurred 20 through the Purchasing Fund. The term "expenses" also shall 21 include the medical costs for the treatment of inmates of State 22 institutions when the inmate must be transferred to an outside 23 hospital: Provided, That in no case shall the State institution 24 pay more for patient care than that provided under the State 25 medical assistance program. 26 Section 103. Abbreviations.--The following abbreviations 27 when used in this act shall have the meanings given to them in 28 this section unless the context clearly indicates otherwise: 29 "ADAMHSBG." State appropriations.--(a) General Fund.--The 12 following sums set forth in this act, or as much thereof as may 13 be necessary, are hereby specifically appropriated from the 14 General Fund to the several hereinafter named agencies of the 15 Executive, Legislative and Judicial Departments of the 16 Commonwealth for the payment of salaries, wages or other 17 compensation and travel expenses of the duly elected or 18 appointed officers and employees of the Commonwealth, for 19 payment of fees of contractual services rendered, for the 20 purchase or rental of goods, services, printing, public 21 advertising by or through any medium, equipment, land and 22 buildings and for payment of any other expenses, as provided by 23 law or by this act, necessary for the proper conduct of the 24 duties, functions and activities and for the purposes 25 hereinafter set forth for the fiscal year beginning July 1, 26 1986, and for the payment of bills incurred and remaining unpaid 27 at the close of the fiscal year ending June 30, 1986. 28 (b) Pennsylvania Economic Revitalization Fund.--The 29 following sums set forth in this act, or as much thereof as may 30 be necessary, are hereby specifically appropriated from the 19860H2508B3515 - 8 -
1 Pennsylvania Economic Revitalization Fund to the several 2 hereinafter named agencies of the Executive Department of the 3 Commonwealth for the payment of fees of contractual services 4 rendered, for the purchase or rental of goods and services and 5 for payment of any other expenses, as provided by law or by this 6 act, necessary for the proper conduct of the duties, functions 7 and activities and for the purposes hereinafter set forth for 8 the fiscal year beginning July 1, 1986, and for the payment of 9 bills incurred and remaining unpaid at the close of the fiscal 10 year ending June 30, 1986. 11 Section 105. Federal augmentation appropriations.--The 12 following Federal augmentation appropriations set forth in this 13 act, or as much thereof as may be necessary, are hereby 14 specifically appropriated from the Federal augmentation funds to 15 the several hereinafter named agencies of the Executive and 16 Judicial Departments of the Commonwealth for the payment of the 17 expenses of implementing and carrying out the programs stated 18 herein for the fiscal year beginning July 1, 1986, and for the 19 payment of bills incurred and remaining unpaid at the close of 20 the fiscal year ending June 30, 1986. Unless otherwise stated, 21 the appropriations include any carryovers from the prior fiscal 22 year. 23 Section 106. Job Training Partnership Act appropriations.-- 24 The following sums as set forth in this act, or as much thereof 25 as may be necessary, are hereby appropriated from the Job 26 Training Partnership Act (JTPA) funds to the several hereinafter 27 named agencies of the Executive Department of the Commonwealth 28 for the payment of the expenses of implementing and carrying out 29 the program stated herein for the fiscal year beginning July 1, 30 1986. 19860H2508B3515 - 9 -
1 Section 107. Jobs Stimulus Bill appropriations.--The 2 following sums set forth in this act, or as much thereof as may 3 be necessary, are hereby specifically appropriated from funds 4 available from the Federal Jobs Stimulus Bill (Public Law 98-8) 5 to the several hereinafter named agencies of the Executive 6 Department of the Commonwealth for the purposes, and under the 7 restrictions, for which the funds are provided for the fiscal 8 year beginning July 1, 1986. 9 Section 108. Block grants.--(a) Appropriation.--The 10 following sums set forth in this act, or as much thereof as may 11 be necessary, are hereby specifically appropriated from the 12 block grant (BG) funds to the several hereinafter named agencies 13 of the Executive Department of the Commonwealth for the 14 purposes, and under the restrictions, for which the funds are 15 provided for the fiscal year beginning July 1, 1986. 16 (b) Small Communities Development Block Grant.--The Small 17 Communities Development Block Grant (SCDBG) is to assist small 18 cities and communities that have a high concentration of 19 impoverished citizens and substandard housing to expand their 20 low and moderate income housing opportunities and to meet 21 community development needs. 22 (c) Community Services Block Grant.--The Community Services 23 Block Grant (CSBG) is to provide a range of services and 24 activities having a measurable and potentially major impact on 25 the causes of poverty in the community or those areas of the 26 community where poverty is a particularly acute problem. In 27 addition, new focus may be placed on the unemployed, both old 28 and new. Local agencies may lower their eligibility requirements 29 for recipients to three months to allow greater flexibility to 30 assure proper consideration of each recipient. 19860H2508B3515 - 10 -
1 (d) Education Consolidation and Improvement Block Grant.-- 2 The Education Consolidation and Improvement Block Grant (ECIBG) 3 will be used for the administration and provision of education 4 programs in accordance with the requirements of the Omnibus 5 Budget Reconciliation Act of 1981. 6 (e) Preventive Health and Health Services Block Grant.--The 7 Preventive Health and Health Services Block Grant (PHHSBG) is 8 for the provision of preventive health and other health services 9 related to emergency medical comprehensive public health, 10 hypertension, fluoridation, health education, risk reduction, 11 home health, rape crisis and rodent control. 12 (f) Maternal and Child Health Services Block Grant.--The 13 Maternal and Child Health Services Block Grant (MCHSBG) is to 14 assure mothers and children access to quality maternal and child 15 health services, to reduce infant mortality and the incidence of 16 preventable disease and handicapping conditions among children, 17 to provide rehabilitative services for blind and disabled 18 individuals under the age of 16 receiving Supplemental Security 19 Income benefits and to provide medical services for children 20 with crippling conditions. 21 (g) Alcohol and Drug Abuse and Mental Health Services Block 22 Grant.--The Alcohol and Drug Abuse and Mental Health Services 23 Block Grant (ADAMHSBG) will be used for the administration and 24 provision of drug and alcohol abuse services and community 25 mental health services in accordance with the requirements of 26 the Omnibus Budget Reconciliation Act of 1981. 27 (h) Low-Income Home Energy Assistance Block Grant.--The Low- 28 Income Home Energy Assistance Block Grant (LIHEABG) is to help 29 lessen the impact of the high cost of energy on low-income 30 families and individuals. 19860H2508B3515 - 11 -
1 (i) Social Services Block Grant.--The Social Services Block 2 Grant (SSBG) is for the provision of social services to eligible 3 persons. 4 PART II 5 GENERAL FUND AND FEDERAL APPROPRIATIONS 6 FOR 1986-1987 7 SUBPART A 8 EXECUTIVE DEPARTMENT 9 Section 201. 1 From the information it receives 2 from colleges and universities or, in 3 the case of State-owned institutions, 4 from the State System of Higher 5 Education, the Department of Education 6 shall certify the number of full-time 7 equivalent undergraduate students 8 attending each eligible institution 9 during the most recent year for which 10 data is available. 11 For the academic year beginning on 12 or about September 1, 1986, the 13 department shall allot directly to 14 eligible institutions on behalf of 15 each full-time equivalent 16 undergraduate student attending an 17 eligible institution as certified a 18 technology grant. Following the 19 initial allocation and allotment, if 20 any funds appropriated have not been 21 and cannot be allocated to one or more 22 institutions otherwise eligible for 23 funds for any reason, the department 24 shall reallocate these funds to the 25 remaining eligible institutions so 26 that all funds herein appropriated 27 have been allotted. 28 Any eligible institution which 29 refuses to submit such information or 30 audit as required in this 19860H2508B3515 - 65 -
1 appropriation or knowingly submits 2 misrepresentations or false statements 3 with the intention of fraudulently 4 obtaining moneys from the department 5 shall be denied status as an eligible 6 institution under the provisions of 7 this appropriation. 8 The following words and phrases 9 when used in this appropriation shall 10 have the meanings given to them in 11 this paragraph unless the context 12 clearly indicates otherwise: 13 "Eligible institution." An 14 independent institution of higher 15 education, a State-owned institution 16 or a State-related institution, any of 17 which is approved by the department. 18 It shall not mean an institution which 19 is determined by the department to be 20 a community college, a medical school, 21 a junior college, a theological 22 seminary or school of theology or a 23 sectarian and denominational 24 institution. 25 "Full-time equivalent undergraduate 26 students." County court 7 administration cost reimbursement.-- 8 The following amounts are appropriated 9 for court costs: Federal State 10 For payment to counties as 11 reimbursement for costs incurred by 12 counties in the administration and 13 operation of courts of common pleas. 14 Reimbursement shall be provided on the 15 following basis. For each common pleas 16 court judge authorized position, 17 whether filled or vacant within a 18 judicial district, $70,000 per 19 authorized position shall be provided. 20 Judicial districts comprising more 21 than one county shall be entitled to 22 receive $70,000 per authorized common 23 pleas court judge position; the amount 24 payable to each county shall be 25 determined by the proportion of the 26 individual county's population in 27 relation to the population of the 28 entire judicial district. 1 capital outlays, incurred by them for 2 the operation of the courts of common 3 pleas. For the purposes of 4 reimbursement for common pleas court 5 judge authorized positions, no county 6 shall receive less than 75% of the 7 actual reimbursement for court costs 8 provided to them from funds 9 appropriated for the fiscal year July 10 1, 1980, to June 30, 1981. 11 For the purpose of determining the 12 actual direct costs incurred by the 13 counties in the administration and 14 operation of the courts of common 15 pleas, the costs as reported to the 16 Department of Community Affairs in the 17 county's annual audit and financial 18 report forms under the heading "(a) 19 Judicial," but confined to the 20 subheading: "(4184) courts, excluding 21 capital outlay," shall be used. If a 22 city coterminous with a county does 23 not report on the Department of 24 Community Affairs' form, its figures 25 from the same subheading, set forth in 26 the department forms, shall be used. 27 All payments for reimbursement 28 shall be made to the county treasurer 29 and, in cities of the first class 30 coterminous with counties of the first 19860H2508B3515 - 193 -

1 mathematics, science, foreign language and computer learning. 2 (15) "Removal of Architectural Barriers" - To fund removal 3 of architectural barriers to handicapped students. 4 Section 405. Additional State appropriations.--The following 7 sums set forth in this act, or as much thereof as may be 8 necessary, are hereby specifically appropriated from the General 9 Fund to the several hereinafter named agencies of the Executive, 10 Legislative and Judicial Departments of the Commonwealth for the 11 payment of salaries, wages or other compensation and travel 12 expenses of the duly elected or appointed officers and employees 13 of the Commonwealth, for payment of fees of contractual services 14 rendered, for the purchase or rental of goods, services, 15 printing, public advertising by or through any medium, 16 equipment, land and buildings and for payment of any other 17 expenses, as provided by law or by this act, necessary for the 18 proper conduct of the duties, functions and activities and for 19 the purposes hereinafter set forth for the fiscal year beginning 20 July 1, 1985, and for the payment of bills incurred and 21 remaining unpaid at the close of the fiscal year ending June 30, 22 1985. 23 Section 502. Department of Public 24 Welfare.--The following additional 25 amounts are appropriated to the 26 Department of Public Welfare: Federal State 27 For cash assistance grants. 28 State appropriation........ 586,633,000 29 PART VI 30 SPECIAL PROVISIONS FOR FEDERAL FUNDS 19860H2508B3515 - 202 -
1 Section 601. General Fund repository for Federal funds.--All 2 moneys received from the Federal Government as contributions or 3 supplements to the departments or agencies of the Commonwealth 4 or the programs herein provided shall be paid into the General 5 Fund and are hereby appropriated out of the General Fund for the 6 purpose of the respective appropriations. 7 Section 602. Limitation on encumbering or spending Federal 8 funds.--Federal funds shall be encumbered or spent only to the 9 extent that such funds are estimated as being available during 10 the fiscal year of the Commonwealth. 11 Section 603. Appropriation of prior unspent Federal funds.-- 12 Any Federal money which has been previously appropriated by the 13 General Assembly and authorized or allocated by the Federal 14 Government but remains unspent from prior fiscal years, and will 15 not be renewed for fiscal year 1986-1987, is hereby 16 appropriated. No funds from any Federal appropriation shall be 17 used to fund the activities of the Human Resources Committee of 18 the Cabinet. 19 Section 604. Subgrants between Federal fund 20 appropriations.--With the exception of Federal money received 21 under JTPA and SSBG, subgrants may be made between 22 appropriations without further approval of the General Assembly. 23 No subgrants shall be made to the Human Resources Committee of 24 the Cabinet. The Secretary of the Budget shall submit a list of 25 subgrants to the Chairmen of the House and Senate Appropriations 26 Committees quarterly. No subgrant to a State agency, however, 27 may be made from a restricted receipt account without a specific 28 appropriation by the General Assembly. 29 Section 605. Utilization of emergency Federal funds.--(a) 30 Federal funds available for costs and damages resulting from 19860H2508B3515 - 203 -
1 natural disasters or civil disobedience may be added to an 2 appropriation contained in this act or to funds appropriated or 3 may be used for the purposes prescribed by the Federal 4 Government. 5 (b) In addition to the moneys appropriated by this act, all 6 moneys received from the Federal Government for the purpose of 7 disaster assistance or relief shall be paid into the General 8 Fund and are hereby appropriated out of the General Fund to the 9 departments, boards, commissions or agencies designated by the 10 Governor. 11 (c) In the event of any emergency situation in which the 12 General Assembly cannot act in sufficient time, the Governor is 13 authorized through executive authorization to provide up to 14 $5,000,000 in Federal funds to alleviate the emergency 15 situation. For the purposes of this section "emergency" is 16 defined as any situation in which there is a chance of, or which 17 may result in, substantial human suffering. 18 PART VII 19 MISCELLANEOUS PROVISIONS 20 Section 701. Prior laws unaffected.--This act is not 21 intended to be inconsistent with or to repeal any provision of 22 any act enacted at this or any prior session of the General 23 Assembly regulating the purchase of supplies, the ordering of 24 printing and binding, the purchase, maintenance and use of 25 automobiles, the method of making payments from the State 26 Treasury for any purpose or the functioning of any 27 administrative department, board or commission. 28 Section 702. Compliance with other law before funds 29 available.--No appropriation made by this act to any department, 30 board, commission or agency of the Executive Department shall be 19860H2508B3515 - 204 -
1 available unless and until the department, board, commission or 2 agency has complied with sections 615 and 616 of the act of 3 April 9, 1929 (P.L.177, No.175), known as The Administrative 4 Code of 1929. 5 Section 703. Contracts prerequisite to encumbering or 6 committing funds.--Funds for the purchase of supplies, materials 7 and equipment shall not be deemed to be committed or encumbered 8 until contracts covering the purchase have been entered into 9 with the vendors. 10 Section 704. Minority business set-asides.--(a) Each 11 department or other instrumentality of the Commonwealth listed 12 in Subpart A of Part II, authorized to contract for buildings, 13 highways, commodities, equipment, supplies or services, shall 14 report to the General Assembly all information pertinent to 15 anticipated procurement needs at the beginning of each fiscal 16 year and each fiscal quarter thereafter. 17 (b) As used in this section the term "minority business" 18 means a minority business enterprise as defined in the act of 19 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 20 Minority Business Development Authority Act. 21 Section 705. Appropriation of funds from miscellaneous 22 sources.--(a) In addition to the amounts appropriated by this 23 act, moneys received in payment for food and household supplies 24 furnished to employees and other persons, except inmates, by an 25 institution, and moneys received from the proceeds from the sale 26 of any products of the soil, meats, livestock, timber or other 27 materials sold by the department shall be paid into the General 28 Fund and are hereby appropriated out of the General Fund to the 29 several respective institutions for the operation and 30 maintenance of the institutions. 19860H2508B3515 - 205 -
1 (b) In addition to the amounts appropriated by this act, all 2 moneys received from any other source, except the Federal 3 Government, as contributions for the programs provided herein or 4 as payment for services or materials furnished by one 5 institution to another, except those collections designated as 6 revenues, shall be paid into the General Fund and are hereby 7 appropriated out of the General Fund for the purposes of the 8 respective appropriations. 9 (c) In addition to any funds specifically appropriated by 10 this act, all moneys received by a department or agency of the 11 Commonwealth from any other sources, except the Federal 12 Government, as contributions or supplements to the department or 13 agency for a program or administration of an act included in 14 this act shall be paid into the General Fund and credited to the 15 appropriation for that program or administration of the act. 16 Section 706. Lapsing of unused funds.--(a) Except as 17 provided in subsections (b), (c), (d), (e) and (f), that part of 18 all appropriations in Part II unexpended, uncommitted or 19 unencumbered as of June 30, 1987, shall automatically lapse as 20 of that date. 21 (b) The appropriations in Part II to the Department of 22 Commerce for the various ports shall be continuing 23 appropriations. 24 (c) The appropriations in Part II to the Department of 25 Community Affairs for housing and redevelopment assistance and 26 enterprise development shall be two-year continuing 27 appropriations. 28 (d) The appropriations in Part II to the Department of 29 Environmental Resources for the Chesapeake Bay Pollution 30 Abatement Program and the hazardous waste control program shall 19860H2508B3515 - 206 -
1 be continuing appropriations. 2 (e) The appropriations in Part II to the Legislative 3 Department shall be continuing appropriations. 4 PART VIII 5 CONSTRUCTION AND EFFECTIVE DATE 6 Section 801. Construction.--(a) The appropriations in 7 section 502 of this act which are the same or similar to any 8 appropriation in Part II of the act of June 30, 1985 (P.L.592, 9 No.5A), known as the General Appropriation Act of 1985, or Part 10 II of the act of May 8, 1986 (P.L. , No.2A), known as the First 11 Supplemental Appropriation Act of 1985, shall replace that 12 appropriation, and all sums expended under the prior 13 appropriations shall be credited against the appropriation 14 contained in section 502. 15 (b) The appropriations in section 302 of this act shall 16 replace the sums appropriated for such purposes in the act of 17 July 2, 1984 (P.L.527, No.106), known as the Recreational 18 Improvement and Rehabilitation Act and in the act of July 1, 19 1985 (P.L.722, No.10A), known as the Pennsylvania Economic 20 Revitalization Fund Appropriation Act of 1985. All sums expended 21 under the prior appropriations shall be credited against the 22 appropriation contained in section 302. 23 Section 802. Effective date.--(a) Sections 501, 502 and 802 24 of this act shall take effect immediately. 25 (b) The remainder of this act shall take effect July 1, 26 1986, or immediately, whichever is later.
