                                     AN ACT

     1  Amending the act of June 30, 1985 (P.L.   , No.5A), entitled "An
     2     act to provide from the General Fund for the expenses of the
     3     Executive, Legislative and Judicial Departments of the
     4     Commonwealth, the public debt and for the public schools for
     5     the fiscal year July 1, 1985, to June 30, 1986, and for the
     6     payment of bills incurred and remaining unpaid at the close
     7     of the fiscal year ending June 30, 1985; to provide
     8     appropriations from the Lottery Fund to the Executive
     9     Department; and to provide for the appropriation of Federal
    10     funds to the Executive and Judicial Departments of the
    11     Commonwealth and for the establishment of restricted receipts
    12     accounts for the fiscal year July 1, 1985, to June 30, 1986,
    13     and for the payment of bills incurred and remaining unpaid at
    14     the close of the fiscal year ending June 30, 1985, and
    15     providing additional appropriations to the Executive and
    16     Judicial Departments of the Commonwealth for the fiscal year
    17     July 1, 1984, to June 30, 1985," prohibiting the funding of
    18     services, by the Philadelphia State Hospital, for mentally
    19     ill persons who are charged with or convicted of a criminal
    20     offense.

    21     The General Assembly of the Commonwealth of Pennsylvania
    22  hereby enacts as follows:
    23     Section 1.  As much as relates to funding of the State mental
    24  hospitals in section 218 of the act of June 30, 1985 (P.L.   ,
    25  No.5A), known as the General Appropriation Act of 1985, is
    26  amended to read:


     1     Section 218.  Department of Public
     2  Welfare.--The following sums are
     3  appropriated to the Department of
     4  Public Welfare:                            Federal       State

     6     For the State mental hospitals and
     7  restoration centers and the care of
     8  patients of such hospitals and
     9  centers. None of this appropriation
    10  shall be used by the Philadelphia
    11  State Hospital to fund services for
    12  mentally ill persons who are charged
    13  with or convicted of a criminal
    14  offense.
    15             State appropriation........               304,578,000
    16     The following Federal augmentation
    17  amounts, or as much thereof as may be
    18  necessary, are hereby specifically
    19  appropriated to supplement the sum
    20  appropriated from Commonwealth
    21  revenues for State mental hospitals
    22  and restorations. None of these
    23  appropriations shall be used by the
    24  Philadelphia State Hospital to fund
    25  services for mentally ill persons who
    26  are charged with or convicted of a
    27  criminal offense:
    28     (1)  "Medical Assistance - State
    29  Mental Hospitals" - For the provision
    30  of medical assistance services to

     1  eligible persons at State mental
     2  hospitals and restoration centers.
     3             Federal appropriation......   97,513,000
     4     (2)  "Medicare Services - State
     5  Mental Hospitals" - For provision of
     6  medical services at State mental
     7  hospitals and restoration centers that
     8  are reimbursable under Medicare.
     9             Federal appropriation......   26,239,000
    10     (3)  "Food Nutrition Service -
    11  State Mental Hospitals" - For
    12  reimbursement for the cost of meals
    13  and milk provided to low-income
    14  children under age 21 in State
    15  institutions.
    16             Federal appropriation......      182,000

    18     Section 2.  This act shall take effect immediately.
