                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for public inspection of certain reports.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 3751(b) of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 3751.  Reports by police.
     8     * * *
     9     (b)  Furnishing copies of report.--Police departments shall
    10  make available for inspection and examination by the public the
    11  full report of the police investigation of any vehicle accident
    12  and shall, upon request, furnish at a cost not to exceed $5 a
    13  certified copy of the full report of the police investigation of
    14  any vehicle accident to any person involved in the accident, his
    15  attorney or insurer, and to the Federal Government, branches of
    16  the military service, Commonwealth agencies, and to officials of
    17  political subdivisions and to agencies of other states and


     1  nations and their political subdivisions. The copy of the report
     2  shall not be admissible as evidence in any action for damages or
     3  criminal proceedings arising out of a motor vehicle accident.
     4  [Police departments may refuse to furnish the complete copy of
     5  investigation of the vehicle accident whenever there are
     6  criminal charges pending against any persons involved in the
     7  vehicle accident unless the Pennsylvania Rules of Criminal
     8  Procedure require the production of the documents.]
     9     Section 2.  This act shall take effect immediately.
