AN ACT
1 Authorizing the Department of Transportation, with the approval
2 of the Governor, to convey to the Wyalusing Municipal
3 Authority approximately one and one-third acres of land
4 located in Wyalusing Borough, Bradford County.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. The Department of Transportation, with the
8 approval of the Governor, is hereby authorized and directed on
9 behalf of the Commonwealth of Pennsylvania to grant and convey
10 to the Wyalusing Municipal Authority, for a consideration of
11 $500, the following tract of land situate in Wyalusing Borough,
12 Bradford County, Pennsylvania, bounded and described as follows:
13 Beginning at a point on the southern right-of-way line of
14 L.R. 241, said point being located south 19 degrees 41 minutes
15 43 seconds west, 85.00 feet from P.T. Sta. 656+89.45 (as shown
16 on plan of L.R. 241 section 17 and L.R. 14, section 14, Bradford
17 County; thence by the following courses and distances: south 70
18 degrees 18 minutes 17 seconds east, 62.65 feet along the
1 southern right-of-way line of L.R. 241; thence leaving the
2 aforementioned right-of-way line south 47 degrees 23 minutes 09
3 seconds east 97.59 feet; thence south 45 degrees 44 minutes 54
4 seconds west 50.09 feet; thence south 36 degrees 58 minutes 38
5 seconds west 47.13 feet; thence south 39 degrees 01 minute 46
6 seconds west 60.41 feet; thence south 46 degrees 15 minutes 38
7 seconds west 51.43 feet; thence south 37 degrees 51 minutes 41
8 seconds west 67.36 feet; thence south 60 degrees 17 minutes 47

18 curve to the left 81.64 feet with a radius of 966.47 feet
19 (Chord: south 67 degrees 53 minutes 08 seconds east 81.62 feet)
20 to the point or place of beginning.
21 Containing approximately 1.274 acres.
22 Being part of the same premises conveyed to the Commonwealth
23 of Pennsylvania, Department of Transportation, by Rose M.
24 Ebertin, also known as, Rose M. Newman (widow) and Margaret E.
25 Saxer (widow) by Deed dated February 14, 1972, and recorded May
26 9, 1972, in Bradford County, Pennsylvania, Deed Book 612, Page
27 790.
28 Section 2. The conveyance shall be made under and subject to
29 all easements, servitudes and rights of others, including, but
30 not confined to, streets, roadways and rights of any telephone,

1 telegraph, water, electric, sewer, gas or pipeline companies, as
2 well as under and subject to any interest, estates or tenancies
3 vested in third persons, whether or not appearing of record, for
4 any portion of the land or improvements erected thereon.
5 Section 3. The deed of conveyance shall contain a clause
6 that the lands conveyed shall be used for municipal authority
7 purposes by the Wyalusing Municipal Authority and, if at any
8 time the Wyalusing Municipal Authority or its successor in
9 function conveys said property or permits said property to be
10 used for any purpose other than those specified in this section,
11 the title thereto shall immediately revert to and revest in the
12 Commonwealth of Pennsylvania.
13 Section 4. The deed of conveyance shall be approved as
14 provided by law and shall be executed by the Secretary of
15 Transportation in the name of the Commonwealth of Pennsylvania.
16 Section 5. Costs and fees incidental to this conveyance
17 shall be borne by the grantee.
18 Section 6. This act shall take effect immediately.
