AN ACT
1 Providing procedures for the expenditure of moneys in coal-
2 producing counties.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Procedure upon implementation.
6 Upon implementation of a permanent regulatory scheme in this
7 Commonwealth in accordance with the Surface Mining Control and
8 Reclamation Act of 1977 (Public Law 95-87, 30 U.S.C. § 1201, et
9 seq.), all moneys received by the Commonwealth from the
10 Abandoned Mine Reclamation Fund representing the State's share
11 shall be expended to effectuate mine reclamation within each
12 coal-producing county, at the same ratio at which fees were
13 collected from that county. Moneys expended shall be in shares
14 directly proportionate to the moneys contributed on a per-county
15 basis.
16 Section 2. Procedure upon completion.
1 Upon completion of all abandoned mine reclamation in a coal-
2 producing county, that county's share of the moneys may be
3 expended in other coal-producing counties at the discretion of
4 the Secretary of Environmental Resources.
5 Section 3. Effective date.
6 This act shall take effect in 60 days.
