AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for handicapped and disabled 3 veterans' parking; and providing penalties. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3354(d) and (e) of Title 75 of the 7 Pennsylvania Consolidated Statutes are amended to read: 8 § 3354. Additional parking regulations. 9 * * * 10 (d) Handicapped persons and disabled veterans.-- 11 (1) When a motor vehicle bearing registration plates or 12 displaying a placard issued to handicapped persons or 13 disabled veterans as prescribed in this title is being 14 operated by or for the transportation of the handicapped 15 person or disabled veteran, the driver shall be relieved of 16 any liability for parking for a period of 60 minutes in 17 excess of the legal parking period permitted by local
1 authorities except where local ordinances or police 2 regulations provide for the accommodation of heavy traffic 3 during morning, afternoon or evening hours. 4 (2) At the request of any handicapped person or disabled 5 veteran, local authorities may erect on the highway as close 6 as possible to their place of residence a sign or signs 7 indicating that that place is reserved for a handicapped 8 person or disabled veteran, that no parking is allowed there 9 by others, and that any unauthorized person parking there 10 shall be subject to a fine. 11 (3) Except for persons parking vehicles lawfully bearing 12 registration plates or parking placards issued to handicapped 13 persons or disabled veterans, no person shall park a vehicle 14 on public or private property reserved for a handicapped 15 person or disabled veteran which property has been so posted 16 in accordance with departmental regulations. 17 (4) Churches, hotels, hospitals, nursing homes, schools, 18 commercial stores, theaters, sports arenas, restaurants, 19 airports and apartments with interior dining facilities open 20 to the public, maintaining parking lots for the use of their 21 customers, shall erect and maintain at their own expense at 22 least one handicapped parking space which shall be marked by 23 a sign which shall be erected and maintained in accordance 24 with departmental regulations. 25 (e) Penalty.--Any person violating subsection (a), (b), [or] 26 (d)(1), (2) or (3) is guilty of a summary offense and shall, 27 upon conviction, be sentenced to pay a fine of not more than 28 $15. Any person violating subsection (d)(4) is guilty of a 29 summary offense and shall, upon conviction, be sentenced to pay 30 a fine of $300. 19850H0291B0315 - 2 -
