                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, requiring the use of safety belts by operators and
     3     other front seat occupants of motor vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 4537.  Use of safety belts.
     9     (a)  General rule.--No person shall operate a motor vehicle
    10  unless he is wearing a safety belt, nor shall he operate a motor
    11  vehicle unless all other front seat occupants are also wearing
    12  safety belts.
    13     (b)  Exceptions.--This section does not apply to the
    14  following:
    15         (1)  The operation of motor vehicles which are not
    16     required to be equipped with safety belts.
    17         (2)  The operator or other occupant of a motor vehicle
    18     with a physically disabling condition whose physical

     1     disability would prevent appropriate restraint by a safety
     2     belt, if the condition is certified by a physician who shall
     3     state the nature of the handicap, as well as the reason such
     4     restraint is inappropriate.
     5         (3)  The operator of a motor vehicle who transports a
     6     child in violation of Subchapter E (relating to child
     7     passenger protection), which shall continue as a separate
     8     offense.
     9     (c)  Penalty.--A person who violates this section commits a
    10  summary offense and shall, upon conviction, be sentenced to pay
    11  a fine of $25.
    12     (d)  Disposition of fines.--All fines collected under this
    13  section shall be deposited in the Catastrophic Loss Trust Fund
    14  established under section 1764 (relating to Catastrophic Loss
    15  Trust Fund).
    16     Section 2.  This act shall take effect January 1, 1986.
