AN ACT
1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2 act to consolidate, editorially revise, and codify the public
3 welfare laws of the Commonwealth," providing that recipients
4 of medical assistance shall not be required to copay for
5 pharmacy services; and negating a portion of a proposed
6 regulation relating to medical assistance.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of June 13, 1967 (P.L.31, No.21), known
10 as the Public Welfare Code, is amended by adding a section to
11 read:
12 Section 443.7. Copayments for Certain Medical Assistance
13 Services Prohibited.--Medical assistance payments to providers
14 on behalf of eligible persons for pharmacy services shall be
15 made in full by the department, without any copayment being
16 required to be paid by the recipient of the pharmacy services.
17 Section 2. That portion of the Department of Public
18 Welfare's proposed medical assistance regulation, amending 55
19 Pa. Code § 1101.63 (relating to payment in full), published on
1 March 17, 1984 in Volume 14, Number 11, of the Pennsylvania
2 Bulletin, which relates to copayment for pharmacy services,
3 shall not be promulgated, or if promulgated shall be null and
4 void.
5 Section 3. This act shall take effect immediately.
