AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for an increase 4 in individual ceilings for allowable net operating costs for 5 intermediate care facilities; AND MAKING APPROPRIATIONS. <-- 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 443.1 of the act of June 13, 1967 9 (P.L.31, No.21), known as the Public Welfare Code, is amended by 10 adding a clause to read: 11 Section 443.1. Medical Assistance Payments for Institutional 12 Care.--The following medical assistance payments shall be made 13 in behalf of eligible persons whose institutional care is 14 prescribed by physicians: 15 * * * 16 (5) Individual ceilings for allowable net operating per diem 17 costs established for the various intermediate care facilities
1 for the fiscal year 1983-1984 shall be increased at a minimum by 2 six percent. THE MEDICAL ASSISTANCE NET OPERATING REIMBURSEMENT <-- 3 CEILINGS FOR THE STATE FISCAL YEAR 1983-1984 SHOULD BE COMPUTED 4 FOLLOWING THE SAME METHODOLOGY USED FOR THE 1982-1983 CEILINGS. 5 NECESSARY ADJUSTMENTS SHOULD BE MADE IN THE GEOGRAPHIC 6 GROUPINGS. The nursing staff allowance recognized for medical 7 assistance reimbursement shall be three and five-tenths nursing 8 hours for skilled nursing facility services and three nursing 9 hours for intermediate care. It is the intent of the General 10 Assembly that the increase is necessary to maintain appropriate 11 care for patients whose services have been redefined by the 12 department's regulations of January 8, 1983 pertaining to levels 13 of care. Individual ceilings for the intermediate care 14 facilities for the fiscal year 1983-1984 shall be increased a 15 minimum of six percent from the ceilings in effect for the 16 fiscal year 1982-1983. 17 Section 2. Any funds in the State Lottery Fund not required <-- 18 for programs for which the money in the fund is otherwise used 19 are hereby appropriated to the Department of Welfare for payment 20 of the increase in allowable net operating costs for 21 intermediate care facilities as provided by this act. 22 SECTION 2. (A) THE SUM OF $7,800,000, OR AS MUCH THEREOF AS <-- 23 MAY BE NECESSARY, IS SPECIFICALLY APPROPRIATED TO THE DEPARTMENT 24 OF PUBLIC WELFARE FOR FISCAL YEAR JULY 1, 1983 TO JUNE 30, 1984 25 FOR MEDICAL ASSISTANCE LONG-TERM CARE FACILITIES. 26 (B) THE SUM OF $9,929,000 IS SPECIFICALLY APPROPRIATED TO 27 THE DEPARTMENT OF PUBLIC WELFARE FROM THE FEDERAL AUGMENTATION 28 FUNDS TO SUPPLEMENT THE SUM APPROPRIATED FROM COMMONWEALTH 29 REVENUES FOR LONG-TERM CARE FACILITIES FOR PROVISION OF SERVICES 30 TO PATIENTS IN LONG-TERM CARE FACILITIES. 19830S0952B1695 - 2 -
1 (C) THE APPROPRIATIONS IN SUBSECTIONS (A) AND (B) SHALL BE 2 IN ADDITION TO ANY SUMS APPROPRIATED IN THE ACT OF JULY 11, 1983 3 (NO.2A), KNOWN AS THE GENERAL APPROPRIATION ACT OF 1983, AND THE 4 ACT OF JULY 21, 1983 (NO.7A), KNOWN AS THE SUPPLEMENTAL GENERAL 5 APPROPRIATION ACT FOR FISCAL YEAR 1983-1984. 6 Section 3.
