        SENATE AMENDMENTS TO HOUSE AMENDMENTS, JULY 19, 1983

                                     AN ACT

     1  Making appropriations from a restricted revenue account within
     2     the General Fund and from Federal augmentation funds to the
     3     Public Utility Commission.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The following sums, or as much thereof as may be   <--
     7  necessary, are hereby specifically appropriated from the
     8  restricted revenue account within the General Fund and from
     9  Federal augmentation funds to the Public Utility Commission to
    10  provide for the operation of the commission for the fiscal
    11  period July 1, 1983 to June 30, 1984, for the purposes and in
    12  the amounts shown:
    13         (1)  For the salaries, wages
    14     and all necessary expenses for the
    15     proper administration of the Public
    16     Utility Commission including the
    17     chairman and commissioners, Office
    18     of the Director of Operations,

     1     Bureau of Public Information,
     2     Office of Special Assistants,
     3     Office of Intergovernmental Affairs
     4     and the Secretary's Bureau.
     5             State appropriation........                 6,215,000
     6         (2)  For the salaries, wages
     7     and all necessary expenses for the
     8     proper administration of the
     9     Offices of Counsel and
    10     Administrative Law Judge.
    11             State appropriation........                 4,667,000
    12         (3)  For the salaries, wages
    13     and all necessary expenses for the
    14     proper administration of rates,
    15     research and transportation
    16     including the Bureau of
    17     Conservation, Economics and Energy
    18     Planning, Bureau of Nonrail
    19     Transportation, Bureau of Rail
    20     Transportation and the Bureau of
    21     Rates.
    22             State appropriation........                 5,826,000
    23         (4)  (i)  For the salaries,
    24     wages and all necessary expenses
    25     for the proper administration of
    26     investigations and enforcement
    27     including the Bureau of Audits and
    28     the Bureau of Safety and
    29     Compliance. Funds from this
    30     appropriation shall be used to

     1     initiate audit surveillance of
     2     major utility construction
     3     projects.
     4             State appropriation........                 4,483,000
     5             (ii)  The following Federal
     6         augmentation amounts, or as
     7         much thereof as may be
     8         necessary, are hereby
     9         specifically appropriated to
    10         supplement the sum authorized
    11         to be billed to utilities for
    12         the operation of the
    13         commission:
    14                 (A)  "Natural Gas
    15             Pipeline Safety" - To
    16             enforce the regulations of
    17             the Natural Gas Pipeline
    18             Safety Act.
    19             Federal appropriation......      133,000            
    20                 (B)  "Railroad Safety"
    21             - For safety inspectors to
    22             survey and patrol over
    23             14,000 miles of trackage to
    24             eliminate derailment and
    25             provide safe rail travel.
    26             Federal appropriation......      225,000            
    27             (iii)  Any Federal funds
    28         which the Public Utility
    29         Commission receives pursuant to
    30         these appropriations shall not

     1         be created to any utility nor
     2         used to lower the annual
     3         assessment of any utility.
     4         (5)  For the salaries, wages
     5     and all necessary expenses for
     6     proper administration of the Bureau
     7     of Consumer Services. Funds from
     8     this appropriation shall be used to
     9     secure equipment and adequate
    10     temporary or permanent staff to
    11     maintain a reasonable completion
    12     rate on the toll free telephone
    13     lines into this bureau. A
    14     reasonable completion rate shall be
    15     a rate where, on a monthly average,
    16     at least 20% of all calls to the
    17     bureau are completed. Progress
    18     toward this goal shall be reported
    19     to the Chairmen of the
    20     Appropriations Committees of the
    21     House of Representatives and Senate
    22     on a quarterly basis.
    23             State appropriation........                 1,488,000
    24     SECTION 1.  THE SUM OF $21,543,000, OR AS MUCH THEREOF AS MAY  <--
    25  BE NECESSARY, IS HEREBY APPROPRIATED FROM THE RESTRICTED REVENUE
    26  ACCOUNT WITHIN THE GENERAL FUND TO THE PUBLIC UTILITY COMMISSION
    27  FOR THE FISCAL YEAR JULY 1, 1983 TO JUNE 30, 1984, TO PROVIDE
    28  FOR THE OPERATION OF THE COMMISSION.
    29     Section 2.  This act shall take effect immediately.
