     5     ACT PROVIDING FOR THE CAPITAL BUDGET FOR THE FISCAL YEAR
     6     1983-1984," ITEMIZING HIGHWAY SAFETY AND IMPROVEMENT PROJECTS
     7     TO BE CONSTRUCTED BY THE DEPARTMENT OF TRANSPORTATION,
     8     TOGETHER WITH THEIR ESTIMATED FINANCIAL COST; AUTHORIZING THE
     9     INCURRING OF DEBT WITHOUT THE APPROVAL OF THE ELECTORS FOR
    10     THE PURPOSE OF FINANCING THE PROJECTS TO BE CONSTRUCTED BY
    11     THE DEPARTMENT OF TRANSPORTATION; STATING THE ESTIMATED
    12     USEFUL LIFE OF THE PROJECTS; MAKING AN APPROPRIATION; AND
    13     MAKING A REPEAL.
    14  AMENDING THE ACT OF JANUARY 22, 1968 (P.L.42, NO.8), ENTITLED,
    15     AS AMENDED, "AN ACT EMPOWERING AND AUTHORIZING THE DEPARTMENT
    16     OF TRANSPORTATION TO ESTABLISH AND ADMINISTER CERTAIN GRANT
    17     PROGRAMS FOR THE BETTERMENT OF MASS TRANSPORTATION SYSTEMS
    18     AND FACILITIES THROUGHOUT THE COMMONWEALTH; PROVIDING FOR
    19     STATE GRANTS TO TRANSPORTATION COMPANIES, MUNICIPALITIES,
    20     COUNTIES, OR THEIR INSTRUMENTALITIES AND TO AGENCIES AND
    21     INSTRUMENTALITIES OF THE COMMONWEALTH FOR STUDIES, RESEARCH,
    22     DEMONSTRATION PROGRAMS, PROMOTION PROGRAMS, PURCHASE OF
    23     SERVICE PROJECTS, AND CAPITAL IMPROVEMENT PROJECTS UNDER
    24     CERTAIN CONDITIONS; AUTHORIZING GRANTS BY COUNTIES OR
    25     MUNICIPALITIES IN METROPOLITAN AREAS TO LOCAL TRANSPORTATION
    26     ORGANIZATIONS, AUTHORIZING THE CREATION OF A TRANSPORTATION
    27     AUTHORITY TO FUNCTION IN EACH METROPOLITAN AREA CONSISTING OF
    28     ANY COUNTY OF THE FIRST CLASS AND ALL NEARBY COUNTIES WITHIN
    29     A RADIUS OF TWENTY MILES OF ANY SUCH FIRST CLASS COUNTY, AS A


     1     BODY CORPORATE AND POLITIC FOR THE PURPOSE OF ESTABLISHING AN
     2     INTEGRATED MASS TRANSPORTATION SYSTEM WITH ALL PERTINENT
     3     POWERS INCLUDING, BUT NOT LIMITED TO, LEASING, ACQUIRING,
     4     OWNING, OPERATING AND MAINTAINING A SYSTEM FOR, OR OTHERWISE
     5     PROVIDING FOR, THE TRANSPORTATION OF PERSONS, AUTHORIZING THE
     6     BORROWING OF MONEY AND ISSUANCE OF BONDS THEREFOR, CONFERRING
     7     THE RIGHT OF EMINENT DOMAIN ON THE AUTHORITY; ALTERING THE
     8     JURISDICTION OF THE PUBLIC UTILITY COMMISSION, AUTHORIZING
     9     THE ACCEPTANCE OF GRANTS FROM FEDERAL, STATE AND LOCAL
    10     GOVERNMENTS, LIMITING ACTIONS AGAINST THE AUTHORITY AND
    11     EXEMPTING IT FROM TAXATION, AUTHORIZING COUNTIES AND
    12     MUNICIPALITIES TO ENTER INTO COMPACTS FOR THE FINANCING OF
    13     EACH AUTHORITY AND TO MAKE APPROPRIATIONS IN ACCORDANCE WITH
    14     SUCH COMPACTS, CREATING A CITIZEN ADVISORY COMMITTEE,
    15     CONFERRING EXCLUSIVE JURISDICTION UPON CERTAIN COURTS WITH
    16     RESPECT TO MATTERS RELATING TO SUCH AUTHORITY, EMPOWERING
    17     EACH AUTHORITY TO FUNCTION OUTSIDE OF THE METROPOLITAN AREA
    18     UNDER CERTAIN TERMS AND CONDITIONS," FURTHER DEFINING
    19     "AVERAGE FARE."

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  The total authorization for the costs of the       <--
    23  project itemized in section 2 and to be financed from the
    24  current revenues of the Motor License Fund shall be $45,000,000.
    25     Section 2.  The individual capital budget project in the
    26  category of a highway and safety improvement project to be
    27  constructed or acquired by the Department of Transportation and
    28  to be financed from the current revenues of the Motor License
    29  Fund is hereby itemized together with its estimated financial
    30  costs as follows:

     8  ITEMIZED IN SECTION 2 AND TO BE CONSTRUCTED BY THE DEPARTMENT OF
     9  TRANSPORTATION, ITS SUCCESSORS OR ASSIGNS AND TO BE FINANCED BY
    10  THE INCURRING OF DEBT, SHALL BE $72,405,000.
    11  SECTION 2.  ITEMIZATION OF HIGHWAY SAFETY AND IMPROVEMENT
    12                 PROJECTS.
    13     ADDITIONAL CAPITAL PROJECTS IN THE CATEGORY OF HIGHWAY SAFETY

     2  CAPITAL BUDGET.
     3  SECTION 4.  ISSUE OF BONDS.
     4     THE INDEBTEDNESS HEREIN AUTHORIZED SHALL BE INCURRED FROM
     5  TIME TO TIME AND SHALL BE EVIDENCED BY ONE OR MORE SERIES OF
     6  GENERAL OBLIGATION BONDS OF THE COMMONWEALTH IN SUCH AGGREGATE
     7  PRINCIPAL AMOUNT FOR EACH SERIES AS THE GOVERNOR, AUDITOR
     8  GENERAL AND STATE TREASURER SHALL DETERMINE, BUT THE LATEST
     9  STATED MATURITY DATE SHALL NOT EXCEED THE ESTIMATED USEFUL LIFE
    10  OF THE PROJECTS BEING FINANCED AS STATED IN SECTION 5.
    11  SECTION 5.  ESTIMATED USEFUL LIFE OF PROJECTS.
    12     THE GENERAL ASSEMBLY STATES THAT THE ESTIMATED USEFUL LIFE OF
    13  THE PUBLIC IMPROVEMENT PROJECTS HERETOFORE ITEMIZED IS 30 YEARS.
    14  THE MAXIMUM TERM OF THE DEBT AUTHORIZED TO BE INCURRED HEREUNDER
    15  IS 30 YEARS.
    16  SECTION 6.  APPROPRIATION.
    17     THE NET PROCEEDS OF THE SALE OF THE OBLIGATIONS HEREIN
    18  AUTHORIZED ARE HEREBY APPROPRIATED FROM THE CAPITAL FACILITIES
    19  FUND TO THE DEPARTMENT OF TRANSPORTATION IN THE MAXIMUM AMOUNT
    20  OF $72,405,000 TO BE USED BY IT EXCLUSIVELY TO DEFRAY THE
    21  FINANCIAL COST OF THE PUBLIC IMPROVEMENT PROJECTS CONSISTING OF
    22  THE HIGHWAY SAFETY AND IMPROVEMENT PROJECTS SPECIFICALLY
    23  ITEMIZED IN A CAPITAL BUDGET. AFTER RESERVING OR PAYING THE
    24  EXPENSES OF THE SALE OF THE OBLIGATION, THE STATE TREASURER
    25  SHALL PAY TO THE DEPARTMENT OF TRANSPORTATION THE MONEYS AS
    26  REQUIRED AND CERTIFIED BY IT TO BE LEGALLY DUE AND PAYABLE.
    27  SECTION 7.  FEDERAL FUNDS.
    28     IN ADDITION TO THOSE FUNDS APPROPRIATED IN SECTION 6, ALL
    29  MONEYS RECEIVED FROM THE FEDERAL GOVERNMENT FOR THE PROJECTS
    30  SPECIFICALLY ITEMIZED HEREIN ARE ALSO HEREBY APPROPRIATED FOR

     2  SECTION 8.  ALLOCATION OF FUNDS.

     4  THAT THE FULL ESTIMATED FINANCIAL COST OF THE HIGHWAY SAFETY AND
     5  IMPROVEMENT PROJECTS ITEMIZED IN SECTION 2 ARE NOT NECESSARY FOR
     6  THE PROPER DESIGN OR CONSTRUCTION OF THE PROJECTS, THE EXCESS
     7  FUNDS NO LONGER REQUIRED MAY BE ALLOCATED TO INCREASE THE
     8  ESTIMATED COST OF ANY ONE OR MORE OF THE HIGHWAY SAFETY AND
     9  IMPROVEMENT PROJECTS SPECIFICALLY ITEMIZED IN A CAPITAL BUDGET.
    10  SECTION 9.  REPEAL.
    11     SECTION 2.A.IX(5) OF THE ACT OF NOVEMBER 20, 1981 (P.L.352,
    12  NO.128), KNOWN AS THE HIGHWAY CAPITAL BUDGET ACT FOR FISCAL YEAR
    13  1981-1982, IS REPEALED.
    14  SECTION 10.  EFFECTIVE DATE.
    15     THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
    16     SECTION 1.  THE DEFINITION OF "AVERAGE FARE" IN SECTION 202
    17  OF THE ACT OF JANUARY 22, 1968 (P.L.42, NO.8), KNOWN AS THE
    18  PENNSYLVANIA URBAN MASS TRANSPORTATION LAW, AMENDED MAY 1, 1984
    19  (P.L.226, NO.49), IS AMENDED TO READ:
    20     SECTION 202.  DEFINITIONS.--THE FOLLOWING TERMS, WHENEVER
    21  USED OR REFERRED TO IN THIS ARTICLE, SHALL HAVE THE FOLLOWING
    22  MEANINGS, EXCEPT IN THOSE INSTANCES WHERE THE CONTEXT CLEARLY
    23  INDICATES A DIFFERENT MEANING:
    24     "AVERAGE FARE" SHALL BE DEFINED AS TOTAL PASSENGER REVENUE
    25  DIVIDED BY THE TOTAL NUMBER OF FARE-PAYING PASSENGERS. WITH
    26  REGARD TO THE CALCULATION OF AVERAGE FARE OR BASE FARE FOR THE
    27  REIMBURSEMENT OF LOSSES RESULTING FROM FREE SERVICE TO SENIOR
    28  CITIZENS AUTHORIZED BY THIS ACT, THE DEPARTMENT OF
    29  TRANSPORTATION SHALL NOT DIFFERENTIATE BETWEEN [SERVICES
    30  PROVIDED BY ANY AGENCY FOR ANY REASON.] BUS SERVICES PROVIDED

     1  WITHIN AN OPERATING UNIT OR DIVISION OF ANY TRANSIT AGENCY FOR
     2  ANY REASON. SERVICES FUNDED UNDER EITHER THE STATE URBAN OR

     4  OPERATING UNITS OR DIVISIONS.
