                                     AN ACT

     1  Establishing a program for providing smoke detectors to elderly
     2     persons by the use of excess lottery funds.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Smoke
     7  Detectors for Senior Citizens Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Agency."  An Area Agency on Aging as designated by the
    13  Department of Aging.
    14     "Department."  The Department of Aging.
    15     "Eligible applicant."  A person who is entitled to any rebate
    16  and assistance pursuant to the act of March 11, 1971 (P.L.104,

     1  No.3), known as the Senior Citizens Rebate and Assistance Act,    <--
     2  AND WHO DOES NOT RESIDE IN A DWELLING WHOSE OWNER OR MANAGER
     3  PROVIDES SMOKE DETECTORS FREE OF CHARGE.
     4     "Program."  The program of providing smoke detectors to
     5  senior citizens established by this act.
     6  Section 3.  Purpose.
     7     A program is hereby established in which moneys can be
     8  withdrawn from the State Lottery Fund by the department for the
     9  purpose of purchasing smoke detectors to be supplied to elderly
    10  persons through Area Agencies on Aging in order to reduce the
    11  number of fire deaths, injuries and property damage of such
    12  older persons by means of an early warning device altering        <--
    13  ALERTING them to possible dangers.                                <--
    14  Section 4.  Application.
    15     Upon application of an eligible applicant to the agency for
    16  the area in which the applicant resides, the agency shall
    17  provide the applicant with a smoke detector or the number of
    18  smoke detectors deemed appropriate to provide adequate
    19  protection in the type of dwelling in which the applicant
    20  resides BUT IN NO CASE SHALL THE AGENCY ISSUE MORE THAN THREE     <--
    21  SMOKE DETECTORS TO AN ELIGIBLE APPLICANT. The application shall
    22  be in the form prescribed by regulations of the department and
    23  shall include, but not be limited to, the following:
    24         (1)  The age and income of the applicant.
    25         (2)  The number of persons in the household.
    26         (3)  The name and address of the owner of the dwelling.
    27         (4)  The type of dwelling.
    28         (5)  A release from liability.
    29         (6)  A STATEMENT INDICATING THAT THE APPLICANT DOES NOT    <--
    30     RESIDE IN A DWELLING WHOSE OWNER OR MANAGER PROVIDES SMOKE

     1     DETECTORS FREE OF CHARGE.
     2         (6) (7)  The signature of the applicant.                   <--
     3  Verification of eligibility shall be in a manner prescribed by
     4  regulation of the department.
     5  Section 5.  Installation, testing and instruction.
     6     Each agency shall arrange for the installation, testing and
     7  instruction on how to use and maintain the smoke detectors.
     8  These services may be performed by personnel of the agency to     <--
     9  the extent that funds are available, or may be performed in
    10  cooperation with volunteer fire companies or other volunteer
    11  agencies willing to participate in the program.
    12  Section 6.  Purchase and specifications.                          <--
    13     The department shall prescribe by regulation the manner of
    14  purchase and the specifications for smoke detectors to be         <--
    15  provided under this program.
    16  Section 7.  Funding.
    17     Funding for the program established by this act shall be from
    18  any excess funds existing in the State Lottery Fund after
    19  payment of all obligations arising under the act of March 11,
    20  1971 (P.L.104, No.3), known as the Senior Citizens Rebate and
    21  Assistance Act, and the act of November 4, 1983 (P.L.217,
    22  No.63), known as the Pharmaceutical Assistance Contract for the
    23  Elderly Act.
    24  Section 8.  Effective date.
    25     This act shall take effect in 60 days.
