AN ACT 1 Amending Title 66 (Public Utilities) of the Pennsylvania 2 Consolidated Statutes, prohibiting resellers from passing on 3 maximum service charges to retail consumers; and making an 4 editorial change. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Sections 1313 and 3313 of Title 66 of the 8 Pennsylvania Consolidated Statutes are amended to read: 9 § 1313. Price upon resale [of public utility services]. 10 Whenever any person, corporation or other entity, not a 11 public utility, electric cooperative corporation, municipality 12 authority or municipal corporation, purchases service from a 13 public utility and resells it to consumers, the bill rendered by 14 the reseller to any residential consumer shall not exceed nor 15 shall the aggregate bills total more than the amount which the 16 public utility would bill its own residential consumers for the 17 same quantity of [service] commodity consumed or discharged 18 under the residential rate of its tariff then currently in
1 effect. Any charges for services not associated directly with 2 the quantity of commodity consumed or discharged shall be passed 3 through to the residential consumer directly and shall not be 4 increased by the reseller to the maximum allowable rate. 5 § 3313. Excessive price on resale. 6 Any person, corporation or other entity violating the 7 provisions of section 1313 (relating to price upon resale [of 8 public utility services]) shall be guilty of a summary offense 9 and shall, upon conviction, be sentenced to pay a fine of $100 10 multiplied by the number of residential bills exceeding the 11 maximum prescribed in section 1313. 12 Section 2.
