AN ACT 1 Amending the act of March 11, 1971 (P.L.104, No.3), entitled, as 2 reenacted and amended, "An act providing property tax or rent 3 rebate and inflation dividends to certain senior citizens, 4 widows, widowers and permanently disabled persons with 5 limited incomes; establishing uniform standards and 6 qualifications for eligibility to receive rebates and 7 dividends; providing for transportation assistance grants and 8 grants to area agencies on aging for services to older 9 persons; and imposing duties upon the Department of Revenue," 10 providing for an energy credit. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Section 3 of the act of March 11, 1971 (P.L.104, 14 No.3), known as the Senior Citizens Rebate and Assistance Act, 15 reenacted and amended June 16, 1975 (P.L.7, No.4), is amended by 16 adding clauses to read: 17 Section 3. Definitions.--As used in this act: 18 * * * 19 (10) "Energy company" means every retail propane dealer that 20 distributes propane by pipeline, every retail coal dealer that
1 distributes coal, every retail oil dealer that distributes oil 2 and every electric light, rural electric, gas or natural gas 3 company. 4 (11) "Energy credit" means a payment made to or on behalf of 5 a claimant in accordance with the provisions of section 4.1. 6 Section 2. The act is amended by adding a section to read: 7 Section 4.1. Energy Credits.--(a) For the purpose of this 8 section, a "claimant" is any person who meets the definition of 9 "claimant" in section 3. 10 (b) In addition to any rebate, dividend or other payment, 11 each claimant shall receive an energy credit determined in 12 accordance with the following schedule: 13 Household Income Energy Credit 14 $ 0 - 4,999 $400 15 5,000 - 5,999 360 16 6,000 - 6,999 320 17 7,000 - 7,999 280 18 8,000 - 8,999 240 19 9,000 - 11,999 200 20 (c) Each claimant who receives a monthly bill or statement 21 from an energy company for heating shall have one-fifth of such 22 energy credit credited to his bill each November, December, 23 January, February and March. 24 (d) Each claimant who is not provided for in subsection (c) 25 shall receive an energy credit determined in accordance with the 26 schedule in subsection (b). The energy credit shall be forwarded 27 to the claimant at the same time the rebate or dividend checks, 28 or both, are forwarded. 29 (e) Every energy company shall comply with the provisions of 30 this section, together with the implementing regulations 19830H1545B1915 - 2 -
1 promulgated by the department. 2 (f) The department shall submit at the beginning of each 3 legislative session a report to the General Assembly outlining 4 recommendations regarding adjustments to the maximum annual 5 income as established by this act. 6 (g) The department shall adopt the regulations necessary to 7 carry out the provisions of this section, which regulations 8 shall provide for the prompt reimbursement to energy companies 9 of energy credits granted under this section. 10 Section 3.
