           DECEMBER 14, 1983

                                     AN ACT

     1  Requiring the superintendent of every public school district and
     2     principal of every CERTAIN parochial, licensed private, and    <--
     3     nonpublic school SCHOOLS to make available, upon request,      <--
     4     lists of graduating seniors to armed forces recruiters; and
     5     providing a penalty for the misuse of any such lists.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Legislative intent.
     9     It is the intent of the General Assembly through this
    10  legislation to assist armed forces recruiters to achieve
    11  additional access to potential recruits by compiling a list of
    12  prospective graduating seniors for distribution, upon written
    13  request, to armed forces recruiters for the cost thereof, for
    14  recruiting purposes only. IT IS FURTHER INTENDED THAT THIS        <--
    15  LEGISLATION COMPLY WITH THE EDUCATION AMENDMENTS OF 1974, PUBLIC
    16  LAW 93-380 (88 STAT. 541, 20 U.S.C. § 1232(G)) AND THE
    17  REGULATIONS ADOPTED PURSUANT TO 34 CFR 99 (RELATING TO PRIVACY
    18  RIGHTS OF PARENTS AND STUDENTS).


     1  Section 2.  List of seniors to be compiled.
     2     (a)  Lists.--Subject to the limitations of subsection (b),
     3  the superintendent of every public school district and the
     4  principal of every parochial, licensed private, and nonpublic
     5  school, EXCEPT A SCHOOL THAT DETERMINES THAT THE COMPILING OF     <--
     6  SUCH A LIST WOULD BE AGAINST THE RELIGIOUS CONVICTIONS OF A
     7  MAJORITY OF ITS SENIOR STUDENTS, shall compile a list of senior
     8  students, both male and female, including home address and
     9  published telephone number who at the end of the respective
    10  academic year will graduate from the school system. The list
    11  shall be compiled within 45 calendar days of the effective date   <--
    12  of this act and in each succeeding year within 45 calendar days
    13  after the start of the academic year in which the senior
    14  students will graduate, COMMENCING WITH THE ACADEMIC YEAR         <--
    15  BEGINNING AT OR ABOUT SEPTEMBER 1984 AND ENDING AT OR ABOUT JUNE
    16  1985.
    17     (b)  Notification.--Each school shall notify the students AND  <--
    18  PARENTS OF STUDENTS UNDER 18 YEARS OF AGE in writing prior to
    19  the end of their junior year of the requirements imposed by
    20  subsection (a). Each student OR PARENT THEREOF shall be given at  <--
    21  least 21 calendar days to request in writing to the
    22  superintendent exclusion of such student's name prior to the
    23  release of such list COMMENCING WITH THE JUNIOR YEAR ENDING AT    <--
    24  OR ABOUT JUNE 1984.
    25  Section 3.  List to be made available.
    26     The list shall be made available to armed forces recruiters
    27  for the active component, the reserve component or AND the        <--
    28  National Guard component of the armed forces.
    29  Section 4.  Penalties.
    30     Any person who violates any section of this act commits a

     1  summary offense and, upon conviction thereof, shall pay a fine
     2  of $100. Each day that any person violates this act shall
     3  constitute a separate offense.
     4  Section 5.  Effective date.
     5     This act shall take effect immediately.
