                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for public hearings
     3     within service areas for certain rate adjustments.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1308 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 1308.  Voluntary changes in rates.
     9     * * *
    10     (f)  Public hearings within service area.--Whenever a public
    11  utility requests, pursuant to subsection (a), (d) or (e), a rate
    12  adjustment which is equal to or in excess of 6% of the utility's
    13  existing rate schedule, the commission shall conduct at least
    14  one public hearing in the service area of the affected public
    15  utility for the purpose of permitting ratepayers to testify as
    16  to the impact of the proposed tariff. The costs of the public

     1  hearing shall be paid solely by the public utility which shall
     2  not be entitled to recoup the costs in any manner. Written
     3  notice of any public hearing shall be given at least 20 days in
     4  advance of the date of the hearing to all members of the General
     5  Assembly and to all media within the affected service area. The
     6  commission shall establish guidelines and procedures for the
     7  conduct of the public hearing.
     8     Section 2.  This act shall take effect in 60 days.
