        AS REPORTED FROM COMMITTEE ON HEALTH AND WELFARE, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JULY 12, 1983

                                     AN ACT

     1  Establishing the Senior Center Grant Program; providing for
     2     grants to senior centers; imposing powers and duties on the
     3     Department of Aging; and making an appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Senior Center
     8  Grant Program Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Area agency on aging."  An agency designated by the
    14  Department of Aging to administer and develop an area plan for a

     1  comprehensive and coordinated system of services for older
     2  people within the boundaries of a defined planning and service
     3  area.
     4     "Department."  The Department of Aging.
     5     "Program."  Senior Center Grant Program.
     6     "Senior center."  A facility where older people gather and
     7  where services are delivered in accordance with the policies and
     8  standards promulgated by the department.
     9  Section 3.  Establishment of program.
    10     There is hereby established the Senior Center Grant Program.
    11  The purpose of the program shall be to provide a one-time grant
    12  to senior centers for the rehabilitation and renovation of
    13  senior centers.
    14  Section 4.  Operation and administration of the program.
    15     (a)  Department.--The program shall be operated and
    16  administered by the department.
    17     (b)  Applications.--Grant applications shall be developed by
    18  the department and distributed to all area agencies on aging.
    19  The regional area agency on aging shall assist the senior center
    20  applying for a grant under this act in completing the
    21  applications and verify, in writing, on the grant application
    22  that the application complies with all the requirements of
    23  section 5. The area agency on aging shall then forward the
    24  application to the department for their approval.
    25  Section 5.  Grant requirements.
    26     (a)  Eligibility.--Grants shall be given by the department to
    27  applying senior centers provided the grant is for any or all of
    28  the following purposes:
    29         (1)  To comply with applicable Federal, State or local
    30     safety standards and other laws so designated by the

     1     department in directives.
     2         (2)  To maintain the senior center in a condition that
     3     provides for the health, welfare and safety of senior
     4     citizens as determined by directives promulgated by the
     5     department.
     6         (3)  To modify the senior center to make it accessible to
     7     the handicapped as determined by directives promulgated by
     8     the department.
     9  Section 6.  Powers and duties of department.
    10     The powers and duties of the department shall be to:
    11         (1)  Accept grants from the Federal Government and any
    12     other individual, agency or government for use in the
    13     program.
    14         (2)  Promulgate such rules, regulations and directives as
    15     it deems necessary to carry out the provisions of this act.
    16  Section 7.  Appropriation.
    17     For the fiscal year 1983-1984, the sum of $10,000,000 is
    18  hereby appropriated from the State Lottery Fund to the
    19  Department of Aging for the Senior Center Grant Program. Eight
    20  million dollars, WHICH SHALL BE ALLOCATED PURSUANT TO THE         <--
    21  ALLOCATION FORMULA SET FORTH IN SECTION 2210-A(A) OF THE ACT OF
    22  APRIL 9, 1929 (P.L.177, NO.175), KNOWN AS THE ADMINISTRATIVE
    23  CODE OF 1929, is to be used for rehabilitation and renovation
    24  grants to senior centers. The remaining $2,000,000 THREE HUNDRED  <--
    25  THOUSAND DOLLARS SHALL BE ALLOCATED FOR THE ADMINISTRATION OF
    26  THIS ACT AND THE REMAINING $1,700,000 shall be withheld by the
    27  Department of Aging for disposition at the discretion of the      <--
    28  secretary IN ACCORDANCE WITH THE PROVISIONS OF SECTION 5. THE     <--
    29  APPROPRIATION MADE BY THIS SECTION SHALL NOT LAPSE AND SHALL
    30  REMAIN AVAILABLE UNTIL EXPENDED.

     1  Section 8.  Effective date.
     2     This act shall take effect immediately.
