        AS REPORTED FROM COMMITTEE ON CONSUMER AFFAIRS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 19, 1983

                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for the OWNERSHIP AND         <--
     3     maintenance of GAS service lines.                              <--

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 102 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a definition           <--
     8  DEFINITIONS to read:                                              <--
     9  § 102.  Definitions.
    10     Subject to additional definitions contained in subsequent
    11  provisions of this part which are applicable to specific
    12  provisions of this part, the following words and phrases when
    13  used in this part shall have, unless the context clearly
    14  indicates otherwise, the meanings given to them in this section:

    16     "Service line."  The piping extending from the curb, property  <--
    17  line or utility connection, whichever is applicable, to a meter

     1  or, if no meter exists, to a point of consumption.
     2     "CUSTOMER'S SERVICE LINE."  THE PIPE AND APPURTENANCES OWNED   <--
     3  BY THE CUSTOMER EXTENDING FROM THE SERVICE CONNECTION OF THE
     4  UTILITY TO THE INLET OF THE METER SERVING THE CUSTOMER.
     5     "SERVICE LINE."  THE PIPE AND APPURTENANCES OF THE PUBLIC
     6  UTILITY WHICH CONNECT ANY MAIN WITH EITHER THE POINT OF
     7  CONNECTION OF A SERVICE LINE OF THE CUSTOMER IF SUCH LINE IS
     8  PROVIDED BY THE CUSTOMER IN ACCORDANCE WITH THE RULES AND
     9  REGULATIONS OF THE PUBLIC UTILITY, OR THE METER OF THE PUBLIC
    10  UTILITY IF THE UTILITY OWNS ALL THE PIPE AND APPURTENANCES
    11  BETWEEN ITS MAIN AND METER.

    13     Section 2.  Title 66 is amended by adding a section to read:
    14  § 1510.  Maintenance of OWNERSHIP AND MAINTENANCE OF NATURAL AND  <--
    15             ARTIFICIAL GAS service lines.
    16     WHEN CONNECTING THE PREMISES OF THE CUSTOMER WITH THE PUBLIC   <--
    17  UTILITY DISTRIBUTION MAINS, THE PUBLIC UTILITY SHALL FURNISH,
    18  INSTALL AND MAINTAIN THE SERVICE LINE OR CONNECTION ACCORDING TO
    19  THE RULES AND REGULATIONS OF THE FILED TARIFF. A PUBLIC UTILITY
    20  SHALL NOT BE AUTHORIZED OR REQUIRED TO ACQUIRE OR ASSUME
    21  OWNERSHIP OF ANY CUSTOMER'S SERVICE LINE. Maintenance of service
    22  lines shall be the responsibility of the owner of the service
    23  line.
    24     Section 3.  This act shall take effect in 60 days.
