           AS AMENDED, MAY 15, 1984

                                     AN ACT

     1  Amending the act of December 20, 1982 (P.L.1442, No.327),
     2     entitled "An act providing for the historic preservation of
     3     the State Capitol Building, establishing a Capitol
     4     Preservation Committee and establishing the Capitol
     5     Restoration Trust Fund," providing for State appropriations
     6     and the status of the committee as an independent agency       <--
     7     OPERATING EXPENSES OF THE COMMITTEE.                           <--

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 4(f) of the act of December 20, 1982
    11  (P.L.1442, No.327), known as the State Capitol Preservation Act,
    12  is amended to read:
    13  Section 4.  Capitol Preservation Committee.

    15     (f)  Expenses.--Committee members shall receive no
    16  compensation for their services but shall be reimbursed for all
    17  necessary travel and other reasonable expenses incurred in
    18  connection with the performance of their duties as members [from
    19  the Capitol Restoration Trust Fund].

     1     Section 2.  Section 6 of the act is amended to read:
     2  Section 6.  Capitol Restoration Trust Fund and operating
     3                 expenses.
     4     (a)  Establishment and administration.--There is hereby
     5  established a separate fund in the State Treasury to be known as
     6  the Capitol Restoration Trust Fund. This fund shall be
     7  administered by the committee and all moneys in the fund are
     8  hereby appropriated to the committee on a continuing basis.
     9     (b)  Purpose.--The moneys in the fund shall be used:
    10         (1)  for the maintenance, restoration, preservation and
    11     rehabilitation of artifacts, documents and other historical
    12     objects or resources located within and around or associated
    13     with the State Capitol Building or acquired by the committee;
    14     and
    15         (2)  for the acquisition of artifacts, documents and
    16     other historical objects or resources, including but not
    17     limited to, statuary, art or any element which contribute to
    18     the historical significancy of the State Capitol Building[;
    19     and
    20         (3)  for the payment of the necessary travel and other
    21     reasonable expenses incurred by members of the committee:
    22     Provided, however, That no more than 0.50% of the trust fund
    23     be set aside for this purpose with the remaining balance at
    24     the end of each calendar year returned to the corpus of the
    25     trust fund].
    26     (c)  Contributions, solicitation of funds.--
    27         (1)  The committee is hereby authorized:
    28             (i)  to accept on behalf of the Commonwealth gifts,
    29         donations, legacies and usages of money from individuals,
    30         organizations, public or private corporations and other

     1         similar entities; and
     2             (ii)  to solicit and raise moneys from public and
     3         private sources through the sale of commemorative medals
     4         and other items of a similar nature which promote the
     5         historic preservation and restoration of the State
     6         Capitol Building.
     7         (2)  [All] Except for appropriations made by the General
     8     Assembly, all moneys received or raised under this section
     9     shall be paid into the State Treasury and credited to the
    10     Capitol Restoration Trust Fund.
    11     (d)  Operating expenses.--Appropriations made by the General
    12  Assembly to the committee shall be used for payment of necessary
    13  travel and other reasonable expenses of committee members, for
    14  the compensation and expenses of staff for the committee, for
    15  administrative expenses, and generally for the purpose of
    16  carrying into effect the provisions of the act.
    17     Section 3.  The act is amended by adding a section to read:    <--
    18  Section 7.1.  Independent agency.
    19     Notwithstanding the provisions of the act of October 15, 1980
    20  (P.L.950, No.164), known as the Commonwealth Attorneys Act, or
    21  any other law, the Capitol Preservation Committee shall be
    22  considered to be an independent agency.
    23     Section 4 3.  This act shall take effect immediately.          <--
