        SENATOR TILGHMAN, APPROPRIATIONS, AS AMENDED, MAY 25, 1982

                                  A SUPPLEMENT

     1  To the act of July 7, 1972 (P.L.743, No.176), entitled "An act
     2     providing for the establishment and operation of Lincoln
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related institution in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; authorizing appropriations in amounts to be fixed
    10     annually by the General Assembly; providing for the auditing
    11     of accounts of expenditures from said appropriations;
    12     providing for public support and capital improvements;
    13     authorizing the issuance of bonds exempt from taxation within
    14     the Commonwealth; requiring the President to make an annual
    15     report of the operations of Lincoln University," making
    16     appropriations for carrying the same into effect, providing
    17     for a basis for payments of such appropriation and providing
    18     a method of accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums, or as much thereof as may be
    22  necessary, is hereby specifically appropriated to the Trustees
    23  of the College of Lincoln University, Chester County, for the
    24  fiscal period July 1, 1982 to June 30, 1983, for the purposes
    25  and in the amounts as shown:


     1     (1)  For educational and general expenses.....    $3,988,000   <--
     2                                                       $4,108,000
     3     (2)  For cost of student aid..................       150,000
     4     (3)  For the master's program in Human
     5          Services.................................       183,000
     6     Section 2.  Payments to Lincoln University on account of the
     7  appropriations for the items provided in section 1 shall be made
     8  on the basis of costs during the fiscal period.
     9     Section 3.  (a)  Payments to Lincoln University of the
    10  appropriation herein provided shall be made monthly during the
    11  fiscal period.
    12     (b)  Such monthly payments shall be made in accordance with
    13  the provisions of section 2, on the basis of estimated costs.
    14  The estimate of costs shall be submitted by Lincoln University
    15  to the Secretary of Education, the General Assembly and to the
    16  State Treasurer not later than 30 days prior to the date on
    17  which such payment is to be made.
    18     Section 4.  Lincoln University shall apply the moneys
    19  appropriated by this act only for such purposes as are permitted
    20  in this act and shall at all times maintain proper records
    21  showing the application of such moneys. Not later than 120 days
    22  after the close of the fiscal period to which this act relates,
    23  Lincoln University shall file with the Secretary of Education,
    24  the General Assembly and with the Auditor General of the
    25  Commonwealth a statement setting forth the amounts and purposes
    26  of all expenditures made from moneys appropriated by this act
    27  and costs, as provided in section 2, used as a basis for receipt
    28  of any appropriation during said fiscal period. Such statement
    29  of expenditures and costs shall be reviewed by the Auditor
    30  General of the Commonwealth, and he shall have the right, in

     1  respect to the moneys appropriated by this act, to audit and
     2  disallow expenditures made for purposes not permitted by this
     3  act. The Auditor General shall also make a determination of
     4  costs and make certification as to their correctness. In respect
     5  to expenditures made by the university from moneys other than
     6  those appropriated by this act, the Auditor General shall have
     7  the right to review only and he shall file annually with the
     8  General Assembly such information concerning said expenditures
     9  as the General Assembly or any of its committees may require.
    10     Section 5.  A report shall be submitted to the Governor and
    11  the Appropriations and Education Committees of the Senate and
    12  House of Representatives and shall include data for all
    13  programs. The report, to be submitted prior to September 1,
    14  1983, shall cover the 12-month period beginning with the summer
    15  term 1982 and shall include:
    16     (1)  The following counts and distributions for each term
    17  during the period:
    18     (i)  The definitions and numbers of faculty members employed
    19  full-time, of faculty members employed part-time, of full-time
    20  students enrolled in graduate courses, of full-time students
    21  enrolled in undergraduate courses, of part-time students
    22  enrolled in graduate courses and of part-time students enrolled
    23  in undergraduate courses.
    24     (ii)  Total numbers of undergraduate student credit hours,
    25  divided into lower division and upper division course levels and
    26  of graduate student credit hours divided into three course
    27  levels: master's, first professional and doctoral.
    28     (iii)  Number of different courses scheduled by level of
    29  instruction and the number of sections of individual instruction
    30  at each level of instruction.

     1     (iv)  Number of terms scheduled and the dates thereof.
     2     (2)  For the summer term and the following academic year in
     3  total and for each two-digit Hegis category of instructional
     4  programs in higher education as defined by the National Center
     5  for Education Statistics, United States Department of Education,
     6  a classification of faculty members or other professional
     7  employees by title including: professor, associate professor,
     8  assistant professor, instructor, lecturer, research associate,
     9  librarian and academic administrator; faculty members or other
    10  professional employees under each title to be subdivided by type
    11  of assignment: teaching and nonteaching, and each such set of
    12  faculty members or other professional employees to be further
    13  subdivided by type of employment: full-time or part-time and the
    14  following aggregates for each such subdivided classification:
    15     (i)  The number of faculty and other professional employees
    16  and their full-time equivalence in instructional and
    17  noninstructional functions.
    18     (ii)  The sum of credits assigned to undergraduate classroom
    19  courses and the sum of credits assigned to graduate classroom
    20  courses taught, divided into lower division, upper division,
    21  master's, first professional and doctoral course levels.
    22     (iii)  The sum of credits assigned to undergraduate
    23  individual instruction courses and the sum of credits assigned
    24  to graduate individual instruction courses taught, divided into
    25  lower division, upper division, master's, first professional and
    26  doctoral course levels.
    27     (iv)  The sum of undergraduate classroom student credit hours
    28  and the sum of graduate classroom student credit hours
    29  generated; divided into lower division, upper division,
    30  master's, first professional and doctoral course levels.

     1     (v)  The sum of undergraduate individual instruction student
     2  credit hours and the sum of graduate individual instruction
     3  student credit hours generated; divided into lower division,
     4  upper division, master's, first professional and doctoral course
     5  levels.
     6     (vi)  Total salary paid for instructional functions and for
     7  noninstructional functions and the amount of this salary paid
     8  for each of these functions from college or university funds,
     9  Federal funds and other funds.
    10     (3)  For each term of the period covered for each faculty
    11  member employed full-time identified by two-digit Hegis category
    12  and title, the report shall contain an analysis of the average
    13  hours per week spent in college or university-related
    14  activities, stating specifically hours spent in undergraduate
    15  classroom contact and graduate classroom contact, hours spent in
    16  preparation, hours spent in research and hours spent in public
    17  service.
    18     Section 6.  (a)  In addition to the above requirements
    19  relative to this appropriation, the report covering the 12-month
    20  period beginning with the summer term 1982, shall include for
    21  all programs of the university:
    22     (1)  Minimum number of credits required for a baccalaureate
    23  degree and for a master's degree.
    24     (2)  Number of bachelor's degrees, master's degrees, first
    25  professional degrees and doctoral degrees awarded in 1980, 1981,
    26  1982 and estimated 1983.
    27     (b)  The university shall report its revenues and
    28  expenditures and present its financial statements required under
    29  the provisions of this act in accordance with "Higher Education
    30  Finance Manual" (1975).

     1     Section 7.  The university shall provide such information as
     2  may be necessary to carry out the provisions of this act and
     3  such form and manner as the Department of Education may
     4  prescribe.
     5     Section 8.  The university shall report its revenues and
     6  expenditures and present its financial statements required under
     7  the provisions of this act in accordance with generally accepted
     8  accounting principles and procedures for educational
     9  institutions as set forth in "Higher Education Finance Manual"
    10  United States Department of Health, Education and Welfare (1975)
    11  with the exceptions set forth in the Commonwealth of
    12  Pennsylvania Budget Instructions for State-Related Universities,
    13  Phase I, Fiscal Year 1982-1983. Credits granted for
    14  nontraditional programs such as CLEP, lifelong learning etc.,
    15  including all related costs and revenues thereof shall be
    16  excluded from the function of "Instruction" and included under
    17  "Public Service."
    18     Section 9.  This act shall take effect July 1, 1982.
