                                  A SUPPLEMENT

     1  To the act of July 7, 1972 (P.L.743, No.176), entitled "An act
     2     providing for the establishment and operation of Lincoln
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related institution in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; authorizing appropriations in amounts to be fixed
    10     annually by the General Assembly; providing for the auditing
    11     of accounts of expenditures from said appropriations;
    12     providing for public support and capital improvements;
    13     authorizing the issuance of bonds exempt from taxation within
    14     the Commonwealth; requiring the President to make an annual
    15     report of the operations of Lincoln University," making
    16     appropriations for carrying the same into effect, providing
    17     for a basis for payments of such appropriation and providing
    18     a method of accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums, or as much thereof as may be
    22  necessary, is hereby specifically appropriated to the Trustees
    23  of the College of Lincoln University, Chester County, for the
    24  fiscal period July 1, 1982 to June 30, 1983, for the purposes
    25  and in the amounts as shown:


     1     (1)  For educational and general expenses.....    $3,988,000
     2     (2)  For cost of student aid..................       150,000
     3     (3)  For the master's program in Human
     4          Services.................................       183,000
     5     Section 2.  Payments to Lincoln University on account of the
     6  appropriations for the items provided in section 1 shall be made
     7  on the basis of costs during the fiscal period.
     8     Section 3.  (a)  Payments to Lincoln University of the
     9  appropriation herein provided shall be made monthly during the
    10  fiscal period.
    11     (b)  Such monthly payments shall be made in accordance with
    12  the provisions of section 2, on the basis of estimated costs.
    13  The estimate of costs shall be submitted by Lincoln University
    14  to the Secretary of Education, the General Assembly and to the
    15  State Treasurer not later than 30 days prior to the date on
    16  which such payment is to be made.
    17     Section 4.  Lincoln University shall apply the moneys
    18  appropriated by this act only for such purposes as are permitted
    19  in this act and shall at all times maintain proper records
    20  showing the application of such moneys. Not later than 120 days
    21  after the close of the fiscal period to which this act relates,
    22  Lincoln University shall file with the Secretary of Education,
    23  the General Assembly and with the Auditor General of the
    24  Commonwealth a statement setting forth the amounts and purposes
    25  of all expenditures made from moneys appropriated by this act
    26  and costs, as provided in section 2, used as a basis for receipt
    27  of any appropriation during said fiscal period. Such statement
    28  of expenditures and costs shall be reviewed by the Auditor
    29  General of the Commonwealth, and he shall have the right, in
    30  respect to the moneys appropriated by this act, to audit and

     1  disallow expenditures made for purposes not permitted by this
     2  act. The Auditor General shall also make a determination of
     3  costs and make certification as to their correctness. In respect
     4  to expenditures made by the university from moneys other than
     5  those appropriated by this act, the Auditor General shall have
     6  the right to review only and he shall file annually with the
     7  General Assembly such information concerning said expenditures
     8  as the General Assembly or any of its committees may require.
     9     Section 5.  A report shall be submitted to the Governor and
    10  the Appropriations and Education Committees of the Senate and
    11  House of Representatives and shall include data for all
    12  programs. The report, to be submitted prior to September 1,
    13  1983, shall cover the 12-month period beginning with the summer
    14  term 1982 and shall include:
    15     (1)  The following counts and distributions for each term
    16  during the period:
    17     (i)  The definitions and numbers of faculty members employed
    18  full-time, of faculty members employed part-time, of full-time
    19  students enrolled in graduate courses, of full-time students
    20  enrolled in undergraduate courses, of part-time students
    21  enrolled in graduate courses and of part-time students enrolled
    22  in undergraduate courses.
    23     (ii)  Total numbers of undergraduate student credit hours,
    24  divided into lower division and upper division course levels and
    25  of graduate student credit hours divided into three course
    26  levels: master's, first professional and doctoral.
    27     (iii)  Number of different courses scheduled by level of
    28  instruction and the number of sections of individual instruction
    29  at each level of instruction.
    30     (iv)  Number of terms scheduled and the dates thereof.

     1     (2)  For the summer term and the following academic year in
     2  total and for each two-digit Hegis category of instructional
     3  programs in higher education as defined by the National Center
     4  for Education Statistics, United States Department of Education,
     5  a classification of faculty members or other professional
     6  employees by title including: professor, associate professor,
     7  assistant professor, instructor, lecturer, research associate,
     8  librarian and academic administrator; faculty members or other
     9  professional employees under each title to be subdivided by type
    10  of assignment: teaching and nonteaching, and each such set of
    11  faculty members or other professional employees to be further
    12  subdivided by type of employment: full-time or part-time and the
    13  following aggregates for each such subdivided classification:
    14     (i)  The number of faculty and other professional employees
    15  and their full-time equivalence in instructional and
    16  noninstructional functions.
    17     (ii)  The sum of credits assigned to undergraduate classroom
    18  courses and the sum of credits assigned to graduate classroom
    19  courses taught, divided into lower division, upper division,
    20  master's, first professional and doctoral course levels.
    21     (iii)  The sum of credits assigned to undergraduate
    22  individual instruction courses and the sum of credits assigned
    23  to graduate individual instruction courses taught, divided into
    24  lower division, upper division, master's, first professional and
    25  doctoral course levels.
    26     (iv)  The sum of undergraduate classroom student credit hours
    27  and the sum of graduate classroom student credit hours
    28  generated; divided into lower division, upper division,
    29  master's, first professional and doctoral course levels.
    30     (v)  The sum of undergraduate individual instruction student

     1  credit hours and the sum of graduate individual instruction
     2  student credit hours generated; divided into lower division,
     3  upper division, master's, first professional and doctoral course
     4  levels.
     5     (vi)  Total salary paid for instructional functions and for
     6  noninstructional functions and the amount of this salary paid
     7  for each of these functions from college or university funds,
     8  Federal funds and other funds.
     9     (3)  For each term of the period covered for each faculty
    10  member employed full-time identified by two-digit Hegis category
    11  and title, the report shall contain an analysis of the average
    12  hours per week spent in college or university-related
    13  activities, stating specifically hours spent in undergraduate
    14  classroom contact and graduate classroom contact, hours spent in
    15  preparation, hours spent in research and hours spent in public
    16  service.
    17     Section 6.  (a)  In addition to the above requirements
    18  relative to this appropriation, the report covering the 12-month
    19  period beginning with the summer term 1982, shall include for
    20  all programs of the university:
    21     (1)  Minimum number of credits required for a baccalaureate
    22  degree and for a master's degree.
    23     (2)  Number of bachelor's degrees, master's degrees, first
    24  professional degrees and doctoral degrees awarded in 1980, 1981,
    25  1982 and estimated 1983.
    26     (b)  The university shall report its revenues and
    27  expenditures and present its financial statements required under
    28  the provisions of this act in accordance with "Higher Education
    29  Finance Manual" (1975).
    30     Section 7.  The university shall provide such information as

     1  may be necessary to carry out the provisions of this act and
     2  such form and manner as the Department of Education may
     3  prescribe.
     4     Section 8.  The university shall report its revenues and
     5  expenditures and present its financial statements required under
     6  the provisions of this act in accordance with generally accepted
     7  accounting principles and procedures for educational
     8  institutions as set forth in "Higher Education Finance Manual"
     9  United States Department of Health, Education and Welfare (1975)
    10  with the exceptions set forth in the Commonwealth of
    11  Pennsylvania Budget Instructions for State-Related Universities,
    12  Phase I, Fiscal Year 1982-1983. Credits granted for
    13  nontraditional programs such as CLEP, lifelong learning etc.,
    14  including all related costs and revenues thereof shall be
    15  excluded from the function of "Instruction" and included under
    16  "Public Service."
    17     Section 9.  This act shall take effect July 1, 1982.
