A SUPPLEMENT 1 To the act of November 30, 1965 (P.L.843, No.355), entitled "An 2 act providing for the establishment and operation of Temple 3 University as an instrumentality of the Commonwealth to serve 4 as a State-related university in the higher education system 5 of the Commonwealth; providing for change of name; providing 6 for the composition of the board of trustees; terms of 7 trustees, and the power and duties of such trustees; 8 providing for preference to Pennsylvania residents in 9 tuition; providing for public support and capital 10 improvements; authorizing appropriations in amounts to be 11 fixed annually by the General Assembly; providing for the 12 auditing of accounts of expenditures from said 13 appropriations; authorizing the issuance of bonds exempt from 14 taxation within the Commonwealth; requiring the President to 15 make an annual report of the operations of Temple 16 University," making appropriations for carrying the same into 17 effect, providing for a basis for payments of such 18 appropriation and providing a method of accounting for the 19 funds appropriated. 20 The General Assembly of the Commonwealth of Pennsylvania 21 hereby enacts as follows: 22 Section 1. The following sums, or as much thereof as may be 23 necessary, are hereby specifically appropriated to the Trustees 24 of Temple University at Philadelphia for the fiscal year July 1, 25 1982 to June 30, 1983, for the purposes and in the amounts as
1 shown: 2 (1) For educational and general expenses...... $75,137,000 3 (2) For cost of student aid................... 3,018,000 4 (3) For instruction - Doctor of Medicine only. 5,704,000 5 (4) For operation of dental clinics in the 6 school of dentistry............................... 724,000 7 (5) Temple University Hospital................ 2,500,000 8 Section 2. Payments to Temple University on account of the 9 appropriations for all items, as provided in section 1, shall be 10 made on the basis of costs during the fiscal year. 11 Section 3. If necessary, Temple University may transfer 12 funds among the appropriations listed in section 1, clauses (1) 13 and (2); Provided, That the aggregate amount transferred into or 14 out of each appropriation during the fiscal year shall not 15 exceed 5% of the amount specifically appropriated for that 16 purpose. 17 Section 4. (a) Payment to Temple University of the 18 appropriations herein provided shall be made monthly during the 19 fiscal year. 20 (b) Such monthly payments shall be made in accordance with 21 the provisions of section 2 on the basis of estimated costs. The 22 estimate of costs shall be submitted by Temple University to the 23 Secretary of Education, the General Assembly and to the State 24 Treasurer not later than 30 days prior to the date on which such 25 payment is to be made. 26 Section 5. Temple University shall apply the moneys 27 appropriated by this act only for such purposes as are permitted 28 in this act and shall at all times maintain proper records 29 showing the application of such moneys. Not later than 120 days 30 after the close of the fiscal year to which this act relates, 19820S1447B1926 - 2 -
1 Temple University shall file with the Secretary of Education, 2 the General Assembly and with the Auditor General of the 3 Commonwealth a statement setting forth the amounts and purposes 4 of all expenditures made from moneys appropriated by this act 5 and other university accounts during said fiscal year, as 6 provided in section 2, used as a basis for receipt of any 7 appropriation during said fiscal year. Such statement of 8 expenditures and costs shall be reviewed by the Auditor General 9 of the Commonwealth, and he shall have the right, in respect to 10 the moneys appropriated by this act, to audit and disallow 11 expenditures made for purposes not permitted by this act and to 12 cause such sums to be recovered and paid by Temple University to 13 the Treasurer of the Commonwealth. In respect to expenditures 14 made by the university from moneys other than those appropriated 15 by this act, the Auditor General shall have the right to review 16 only and he shall file annually with the General Assembly such 17 information concerning said expenditures as the General Assembly 18 or any of its committees may require. 19 Section 6. A report shall be submitted to the Governor and 20 the Appropriations and Education Committees of the Senate and 21 House of Representatives and shall include data for all programs 22 except the Doctor of Medicine program. The report, to be 23 submitted prior to September 1, 1983, shall cover the 12-month 24 period beginning with the summer term 1982 and shall include: 25 (1) The following counts and distributions for each term 26 during the period: 27 (i) The definitions and numbers of faculty members employed 28 full-time, of faculty members employed part-time, of full-time 29 students enrolled in graduate courses, of full-time students 30 enrolled in undergraduate courses, of part-time students 19820S1447B1926 - 3 -
1 enrolled in graduate courses, and of part-time students enrolled 2 in undergraduate courses. 3 (ii) Total numbers of undergraduate student credit hours, 4 divided into lower division and upper division course levels, 5 and of graduate student credit hours divided into three course 6 levels--master's, first professional and doctoral. 7 (iii) Number of different courses scheduled by level of 8 instruction and the number of sections of individual instruction 9 at each level of instruction. 10 (iv) Number of terms scheduled and the dates thereof. 11 (2) For the summer term and the following academic year in 12 total and for each two-digit Hegis category of instructional 13 programs in higher education as defined by the National Center 14 for Education Statistics, United States Department of Education, 15 a classification of faculty members or other professional 16 employees by title including: professor, associate professor, 17 assistant professor, instructor, lecturer, research associate, 18 librarian and academic administrator; faculty members or other 19 professional employees under each title to be subdivided by type 20 of assignment: teaching and nonteaching, and each such set of 21 faculty members or other professional employees to be further 22 subdivided by type of employment: full-time or part-time and the 23 following aggregates for each such subdivided classification: 24 (i) The number of faculty and other professional employees 25 and their full-time equivalence in instructional and 26 noninstructional functions. 27 (ii) The sum of credits assigned to undergraduate classroom 28 courses and the sum of credits assigned to graduate classroom 29 courses taught, divided into lower division, upper division, 30 master's, first professional and doctoral course levels. 19820S1447B1926 - 4 -
1 (iii) The sum of credits assigned to undergraduate 2 individual instruction courses and the sum of credits assigned 3 to graduate individual instruction courses taught, divided into 4 lower division, upper division, master's, first professional and 5 doctoral course levels. 6 (iv) The sum of undergraduate classroom student credit hours 7 and the sum of graduate classroom student credit hours 8 generated; divided into lower division, upper division, 9 master's, first professional and doctoral course levels. 10 (v) The sum of undergraduate individual instruction student 11 credit hours and the sum of graduate individual instruction 12 student credit hours generated; divided into lower division, 13 upper division, master's, first professional and doctoral course 14 levels. 15 (vi) Total salary paid for instructional functions and for 16 noninstructional functions and the amount of this salary paid 17 for each of these functions from college or university funds, 18 Federal funds and other funds. 19 (3) For each term of the period covered for each faculty 20 member employed full-time identified by two-digit Hegis category 21 and title, the report shall contain an analysis of the average 22 hours per week spent in college or university-related 23 activities, stating specifically hours spent in undergraduate 24 classroom contact and graduate classroom contact, hours spent in 25 preparation, hours spent in research and hours spent in public 26 service. 27 Section 7. (a) In addition to the above requirements 28 relative to this appropriation, the report covering the 12-month 29 period beginning with the summer term 1982, shall include for 30 all programs of the university: 19820S1447B1926 - 5 -
1 (1) Minimum number of credits required for a baccalaureate 2 degree and for a master's degree. 3 (2) Number of bachelor's degrees, master's degrees, first 4 professional degrees and doctoral degrees awarded in 1980, 1981, 5 1982 and estimated 1983. 6 (b) The university shall report its revenues and 7 expenditures and present its financial statements required under 8 the provisions of this act in accordance with "Higher Education 9 Finance Manual" (1975). 10 Section 8. The university shall provide such information as 11 may be necessary to carry out this act and in such form and 12 manner as the Department of Education may prescribe. 13 Section 9. The university shall report its revenues and 14 expenditures and present its financial statements required under 15 the provisions of this act in accordance with generally accepted 16 accounting principles and procedures for educational 17 institutions as set forth in "Higher Education Finance Manual" 18 United States Department of Health, Education and Welfare (1975) 19 with the exceptions set forth in the Commonwealth of 20 Pennsylvania Budget Instructions for State Related Universities, 21 Phase I, Fiscal Year 1982-1983. Credits granted for 22 nontraditional programs such as CLEP, lifelong learning etc., 23 including all related costs and revenues thereof shall be 24 excluded from the function of "Instruction" and included under 25 "Public Service." 26 Section 10.
