                                  A SUPPLEMENT

     1  To the act of July 28, 1966 (3rd Sp.Sess., P.L.87, No.3),
     2     entitled "An act providing for the establishment and
     3     operation of the University of Pittsburgh as an
     4     instrumentality of the Commonwealth to serve as a State-
     5     related university in the higher education system of the
     6     Commonwealth; providing for change of name; providing for the
     7     composition of the board of trustees; terms of trustees, and
     8     the power and duties of such trustees; authorizing
     9     appropriations in amounts to be fixed annually by the General
    10     Assembly; providing for the auditing of accounts of
    11     expenditures from said appropriations; providing for public
    12     support and capital improvements; authorizing the issuance of
    13     bonds exempt from taxation within the Commonwealth; requiring
    14     the chancellor to make an annual report of the operations of
    15     the University of Pittsburgh," making appropriations for
    16     carrying the same into effect, providing for a basis for
    17     payments of such appropriations and providing a method of
    18     accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums or as much thereof as may be
    22  necessary, are hereby specifically appropriated to the Trustees
    23  of the University of Pittsburgh for the fiscal year July 1, 1982
    24  to June 30, 1983, for the purpose and in the amounts as shown:
    25     (1)  For educational and general expenses.....   $69,691,000


     1     (2)  For cost of student aid..................     2,960,000
     2     (3)  For instruction - Doctor of Medicine only     4,285,000
     3     (4)  For operation of dental clinics in the
     4          school of dentistry......................       724,000
     5     (5)  For operations of the Titusville Campus..       575,000
     6     Section 2.  Payments to the University of Pittsburgh on
     7  account of the appropriations for all items, as provided in
     8  section 1, shall be made on the basis of costs during the fiscal
     9  year.
    10     Section 3.  If necessary the University of Pittsburgh may
    11  transfer funds between the appropriations listed in section 1,
    12  clauses (1) and (2): Provided, That the aggregate amount
    13  transferred into or out of each appropriation during the fiscal
    14  year shall not exceed 5% of the amount specifically appropriated
    15  for that purpose.
    16     Section 4.  (a)  Payments to the University of Pittsburgh of
    17  the appropriations herein provided shall be made monthly during
    18  the fiscal year.
    19     (b)  Such monthly payments shall be made in accordance with
    20  the provisions of section 2 on the basis of estimated costs. The
    21  estimate of costs shall be submitted by the University of
    22  Pittsburgh to the Secretary of Education, the General Assembly
    23  and to the Treasurer of the Commonwealth not later than 30 days
    24  prior to the date on which such payment is to be made.
    25     Section 5.  (a)  The University of Pittsburgh shall apply the
    26  moneys appropriated by this act only for such purposes as are
    27  permitted in this act and shall at all times maintain proper
    28  records showing the application of such moneys. Not later than
    29  120 days after the close of the fiscal year to which this act
    30  relates, the University of Pittsburgh shall file with the

     1  Secretary of Education, the General Assembly, the Auditor
     2  General of the Commonwealth and the chief administrator of each
     3  branch campus, a statement setting forth the amounts and
     4  purposes of all expenditures made from moneys appropriated by
     5  this act and other university accounts during said fiscal year,
     6  as provided in section 2, used as a basis for receipt of any
     7  appropriation during said fiscal year.
     8     (b)  Such statement of expenditures and costs shall be
     9  reviewed by the Auditor General of the Commonwealth, and he
    10  shall have the right, in respect to the moneys appropriated by
    11  this act, to audit and disallow expenditures made for purposes
    12  not permitted by this act and to cause such sums to be recovered
    13  and paid by the University of Pittsburgh to the Treasurer of the
    14  Commonwealth. In respect to expenditures made by the university
    15  from moneys other than those appropriated by this act, the
    16  Auditor General shall have the right to review only and he shall
    17  file annually with the General Assembly such information
    18  concerning such expenditures as the General Assembly or any of
    19  its committees may require.
    20     Section 6.  A report shall be submitted to the Governor and
    21  the Appropriations and Education Committees of the Senate and
    22  House of Representatives and shall include data for all
    23  programs, except the Doctor of Medicine program. The report, to
    24  be submitted prior to September 1, 1983, shall cover the 12-
    25  month period beginning with the summer term 1982 and shall
    26  include:
    27     (1)  The following counts and distributions for each term
    28  during the period:
    29     (i)  The definitions and numbers of faculty members employed
    30  full-time, of faculty members employed part-time, of full-time

     1  students enrolled in graduate courses, of full-time students
     2  enrolled in undergraduate courses, of part-time students
     3  enrolled in graduate courses and of part-time students enrolled
     4  in undergraduate courses.
     5     (ii)  Total numbers of undergraduate student credit hours,
     6  divided into lower division and upper division course levels,
     7  and of graduate student credit hours divided into three course
     8  levels--master's, first professional and doctoral.
     9     (iii)  Number of different courses scheduled by level of
    10  instruction and the number of sections of individual instruction
    11  at each level of instruction.
    12     (iv)  Number of terms scheduled and dates thereof.
    13     (2)  For the summer term and the following academic year in
    14  total and for each two-digit Hegis category of instructional
    15  programs in higher education as defined by the National Center
    16  for Education Statistics, United States Department of Education,
    17  a classification of faculty members or other professional
    18  employees by title including: professor, associate professor,
    19  assistant professor, instructor, lecturer, research associate,
    20  librarian and academic administrator; faculty members or other
    21  professional employees under each title to be subdivided by type
    22  of assignment: teaching and nonteaching, and each such set of
    23  faculty members or other professional employees to be further
    24  subdivided by type of employment: full-time or part-time and the
    25  following aggregates for each such subdivided classification:
    26     (i)  The number of faculty and other professional employees
    27  and their full-time equivalence in instructional and
    28  noninstructional functions.
    29     (ii)  The sum of credits assigned to undergraduate classroom
    30  courses and the sum of credits assigned to graduate classroom

     1  courses taught, divided into lower division, upper division,
     2  master's, first professional and doctoral course levels.
     3     (iii)  The sum of credits assigned to undergraduate
     4  individual instruction courses and the sum of credits assigned
     5  to graduate individual instruction courses taught, divided into
     6  lower division, upper division, master's, first professional and
     7  doctoral course levels.
     8     (iv)  The sum of undergraduate classroom student credit hours
     9  and the sum of graduate classroom student credit hours
    10  generated; divided into lower division, upper division,
    11  master's, first professional and doctoral course levels.
    12     (v)  The sum of undergraduate individual instruction student
    13  credit hours and the sum of graduate individual instruction
    14  student credit hours generated; divided into lower division,
    15  upper division, master's, first professional and doctoral course
    16  levels.
    17     (vi)  Total salary paid for instructional functions and for
    18  noninstructional functions and the amount of this salary paid
    19  for each of these functions from college or university funds,
    20  Federal funds and other funds.
    21     (3)  For each term of the period covered for each faculty
    22  member employed full-time identified by two-digit Hegis category
    23  and title, the report shall contain an analysis of the average
    24  hours per week spent in college or university-related
    25  activities, stating specifically hours spent in undergraduate
    26  classroom contact and graduate classroom contact, hours spent in
    27  preparation, hours spent in research and hours spent in public
    28  service.
    29     Section 7.  (a)  In addition to the above requirements
    30  relative to this appropriation, the report covering the 12-month

     1  period beginning with the summer term 1982, shall include for
     2  all programs of the university:
     3     (1)  Minimum number of credits required for a baccalaureate
     4  degree and for a master's degree.
     5     (2)  Number of bachelor's degrees, master's degrees, first
     6  professional degrees, and doctoral degrees awarded in 1980,
     7  1981, 1982 and estimated 1983.
     8     (b)  The university shall report its revenues and
     9  expenditures and present its financial statements required under
    10  the provisions of this act in accordance with "Higher Education
    11  Finance Manual" (1975).
    12     Section 8.  The university shall provide such information as
    13  may be necessary to carry out the provisions of this act and in
    14  such form and manner as the Department of Education may
    15  prescribe.
    16     Section 9.  The university shall report its revenues and
    17  expenditures and present its financial statements required under
    18  the provisions of this act in accordance with generally accepted
    19  accounting principles and procedures for educational
    20  institutions as set forth in "Higher Education Finance Manual"
    21  United States Department of Health, Education and Welfare (1975)
    22  with the exceptions set forth in the Commonwealth of
    23  Pennsylvania Budget Instructions for State Related Universities,
    24  Phase I, Fiscal Year 1982-1983. Credits granted for
    25  nontraditional programs such as CLEP, lifelong learning etc.,
    26  including all related costs and revenues thereof shall be
    27  excluded from the function of "Instruction" and included under
    28  "Public Service."
    29     Section 10.  In addition to the requirements of section 6,
    30  the University of Pittsburgh shall, by March 1, 1983, submit to

     1  the Appropriations and Education Committees of the Senate and
     2  the House of Representatives a breakdown of the funds budgeted
     3  for this fiscal year for the main campus and each branch campus
     4  including expenditures budgeted from this act and expenditures
     5  budgeted from moneys other than those appropriated by this act.
     6     Section 11.  This act shall take effect July 1, 1982.
