SENATE BILL

        INTRODUCED BY HOWARD, MANBECK, TILGHMAN, LEWIS, MESSINGER,
           HAGER, CORMAN, HOPPER, STAUFFER, SNYDER, STREET, PRICE,
           FISHER, HELFRICK, RHOADES, O'CONNELL AND SHAFFER, JUNE 16,
           1981

        AS AMENDED ON THIRD CONSIDERATION, OCTOBER 6, 1981

                                     AN ACT

     1  Amending Titles 24 (Education) and 71 (State Government) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     membership on the State Employees' Retirement Board and the
     4     Public School Employees' Retirement Board.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 8501(a) of Title 24, act of November 25,
     8  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     9  Statutes, is amended to read:
    10  § 8501.  Public School Employees' Retirement Board.
    11     (a)  Status and membership.--The board shall be an
    12  independent administrative board and shall consist of [11] 15
    13  members: the Secretary of Education, ex officio; the State
    14  Treasurer, ex officio; two senators; two members of the House of
    15  Representatives; the executive secretary of the Pennsylvania
    16  School Boards Association, ex officio; two to be appointed by
    17  the Governor, at least one of whom shall not be a school
    18  employee or an officer or employee of the State; three to be

     1  elected by the active professional members of the system from
     2  among their number; one to be elected by annuitants from among
     3  their number; one to be elected by the active nonprofessional
     4  members of the system from among their number; and one to be
     5  elected by members of Pennsylvania public school boards from
     6  among their number. The appointments made by the Governor shall
     7  be confirmed by the Senate and each election shall be conducted
     8  in a manner approved by the board. The terms of the appointed
     9  and nonlegislative elected members shall be three years. The
    10  members from the Senate shall be appointed by the President pro
    11  tempore of the Senate and shall consist of a majority and a
    12  minority member. The members from the House of Representatives
    13  shall be appointed by the Speaker of the House of
    14  Representatives and shall consist of a majority and a minority
    15  member. The legislative members shall serve on the board for the
    16  duration of the terms for which they were elected. The chairman
    17  of the board shall be elected by the board members. Each ex
    18  officio member of the board may appoint a duly authorized
    19  designee to act in his stead.

    21     Section 2.  Section 5901(a) and (b) of Title 71 are amended
    22  to read:
    23  § 5901.  The State Employees' Retirement Board.
    24     (a)  Status and membership.--The board shall be an
    25  independent administrative board and consist of [seven] 11
    26  members: the State Treasurer, ex officio, two Senators, two
    27  members of the House of Representatives, and six members
    28  appointed by the Governor, ONE OF WHOM SHALL BE AN ANNUITANT OF   <--
    29  THE SYSTEM, for terms of four years, subject to confirmation by
    30  the Senate. At least five board members shall be active members

     1  of the system, and at least two shall have ten or more years of
     2  credited State service. The chairman of the board shall be
     3  designated by the Governor from among the members of the board.
     4     (b)  Appointments and terms.--The two members elected by the
     5  board and serving on the effective date of this title shall
     6  continue to serve until the expiration of their respective
     7  terms. The members of the Senate shall be appointed by the
     8  President pro tempore of the Senate and shall consist of a
     9  majority and a minority member. The members of the House of
    10  Representatives shall be appointed by the Speaker of the House
    11  of Representatives and shall consist of a majority and a
    12  minority member. The legislative members shall serve on the
    13  board for the duration of the terms for which they were elected.
    14  Of the remaining four appointees, one shall be appointed for an
    15  initial term of two years, one for an initial term of three
    16  years, and two for an initial term of four years. A vacancy
    17  occurring during the term of an appointed member shall be filled
    18  for the unexpired term by the appointment and confirmation of a
    19  successor in the same manner as his predecessor. No appointed
    20  member shall serve more than two consecutive full terms.
