AN ACT 1 Amending Titles 24 (Education) and 71 (State Government) of the 2 Pennsylvania Consolidated Statutes, further providing for 3 membership on the State Employees' Retirement Board and the 4 Public School Employees' Retirement Board. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 8501(a) of Title 24, act of November 25, 8 1970 (P.L.707, No.230), known as the Pennsylvania Consolidated 9 Statutes, is amended to read: 10 § 8501. Public School Employees' Retirement Board. 11 (a) Status and membership.--The board shall be an 12 independent administrative board and shall consist of [11] 13 15 <-- 13 members: the Secretary of Education, ex officio; the State 14 Treasurer, ex officio; one Senator; one member TWO SENATORS; TWO <-- 15 MEMBERS of the House of Representatives; the executive secretary 16 of the Pennsylvania School Boards Association, ex officio; two 17 to be appointed by the Governor, at least one of whom shall not 18 be a school employee or an officer or employee of the State;
1 three to be elected by the active professional members of the 2 system from among their number; one to be elected by annuitants 3 from among their number; one to be elected by the active 4 nonprofessional members of the system from among their number; 5 and one to be elected by members of Pennsylvania public school 6 boards from among their number. The appointments made by the 7 Governor shall be confirmed by the Senate and each election 8 shall be conducted in a manner approved by the board. The terms 9 of the appointed and nonlegislative elected members shall be 10 three years. The member MEMBERS from the Senate shall be <-- 11 appointed by the President pro tempore of the Senate and the <-- 12 member AND SHALL CONSIST OF A MAJORITY AND A MINORITY MEMBER. <-- 13 THE MEMBERS from the House of Representatives shall be appointed 14 by the Speaker of the House of Representatives AND SHALL CONSIST <-- 15 OF A MAJORITY AND A MINORITY MEMBER. The legislative members 16 shall serve on the board for the duration of the terms for which 17 they were elected. The chairman of the board shall be elected by 18 the board members. Each ex officio member of the board may 19 appoint a duly authorized designee to act in his stead. 20 * * * 21 Section 2. Section 5901(a) and (b) of Title 71 are amended 22 to read: 23 § 5901. The State Employees' Retirement Board. 24 (a) Status and membership.--The board shall be an 25 independent administrative board and consist of [seven] nine 11 <-- 26 members: the State Treasurer, ex officio, one Senator, one <-- 27 member TWO SENATORS, TWO MEMBERS of the House of <-- 28 Representatives, and six members appointed by the Governor for 29 terms of four years, subject to confirmation by the Senate. 1 and at least two shall have ten or more years of credited State 2 service. The chairman of the board shall be designated by the 3 Governor from among the members of the board. 4 (b) Appointments and terms.--The two members elected by the 5 board and serving on the effective date of this title shall 6 continue to serve until the expiration of their respective 7 terms. The member MEMBERS of the Senate shall be appointed by <-- 8 the President pro tempore of the Senate and the member AND SHALL <-- 9 CONSIST OF A MAJORITY AND A MINORITY MEMBER. THE MEMBERS of the 10 House of Representatives shall be appointed by the Speaker of 11 the House of Representatives AND SHALL CONSIST OF A MAJORITY AND <-- 12 A MINORITY MEMBER. The legislative members shall serve on the 13 board for the duration of the terms for which they were elected. 14 Of the remaining four appointees, one shall be appointed for an 15 initial term of two years, one for an initial term of three 16 years, and two for an initial term of four years. A vacancy 17 occurring during the term of an appointed member shall be filled 18 for the unexpired term by the appointment and confirmation of a 19 successor in the same manner as his predecessor.
