                                     AN ACT

     1  Amending Titles 24 (Education) and 71 (State Government) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     membership on the State Employees' Retirement Board and the
     4     Public School Employees' Retirement Board.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 8501(a) of Title 24, act of November 25,
     8  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     9  Statutes, is amended to read:
    10  § 8501.  Public School Employees' Retirement Board.
    11     (a)  Status and membership.--The board shall be an
    12  independent administrative board and shall consist of [11] 13
    13  members: the Secretary of Education, ex officio; the State
    14  Treasurer, ex officio; one Senator; one member of the House of
    15  Representatives; the executive secretary of the Pennsylvania
    16  School Boards Association, ex officio; two to be appointed by
    17  the Governor, at least one of whom shall not be a school
    18  employee or an officer or employee of the State; three to be

     1  elected by the active professional members of the system from
     2  among their number; one to be elected by annuitants from among
     3  their number; one to be elected by the active nonprofessional
     4  members of the system from among their number; and one to be
     5  elected by members of Pennsylvania public school boards from
     6  among their number. The appointments made by the Governor shall
     7  be confirmed by the Senate and each election shall be conducted
     8  in a manner approved by the board. The terms of the appointed
     9  and nonlegislative elected members shall be three years. The
    10  member from the Senate shall be appointed by the President pro
    11  tempore of the Senate and the member from the House of
    12  Representatives shall be appointed by the Speaker of the House
    13  of Representatives. The legislative members shall serve on the
    14  board for the duration of the terms for which they were elected.
    15  The chairman of the board shall be elected by the board members.
    16  Each ex officio member of the board may appoint a duly
    17  authorized designee to act in his stead.

    19     Section 2.  Section 5901(a) and (b) of Title 71 are amended
    20  to read:
    21  § 5901.  The State Employees' Retirement Board.
    22     (a)  Status and membership.--The board shall be an
    23  independent administrative board and consist of [seven] nine
    24  members: the State Treasurer, ex officio, one Senator, one
    25  member of the House of Representatives, and six members
    26  appointed by the Governor for terms of four years, subject to
    27  confirmation by the Senate. At least five board members shall be
    28  active members of the system, and at least two shall have ten or
    29  more years of credited State service. The chairman of the board
    30  shall be designated by the Governor from among the members of

     1  the board.
     2     (b)  Appointments and terms.--The two members elected by the
     3  board and serving on the effective date of this title shall
     4  continue to serve until the expiration of their respective
     5  terms. The member of the Senate shall be appointed by the
     6  President pro tempore of the Senate and the member of the House
     7  of Representatives shall be appointed by the Speaker of the
     8  House of Representatives. The legislative members shall serve on
     9  the board for the duration of the terms for which they were
    10  elected. Of the remaining four appointees, one shall be
    11  appointed for an initial term of two years, one for an initial
    12  term of three years, and two for an initial term of four years.
    13  A vacancy occurring during the term of an appointed member shall
    14  be filled for the unexpired term by the appointment and
    15  confirmation of a successor in the same manner as his
    16  predecessor. No appointed member shall serve more than two
    17  consecutive full terms.
