                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing that certain
     3     competition between individuals and the promotion of such
     4     competition be unlawful and providing specific penalties for
     5     certain activities related to such competition.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 18, act of November 25, 1970 (P.L.707,
     9  No.230), known as the Pennsylvania Consolidated Statutes, is
    10  amended by adding a section to read:
    11  § 7107.  Tough guy competition.
    12     (a)  General rule.--It shall be unlawful for any person or
    13  corporation to promote, sponsor or to participate in any manner
    14  in the staging of, or the conduct of, any competition referred
    15  to as a tough guy contest or a battle of the brawlers or in any
    16  similar competition.
    17     (b)  Specific penalties.--
    18         (1)  The promotion of any competition which is prohibited
    19     in subsection (a) is a misdemeanor of the first degree. Any

     1     person who is or any corporation which is found guilty of
     2     promoting such competition shall be sentenced to pay a fine
     3     of $25,000.
     4         (2)  The sponsorship of any competition which is
     5     prohibited in subsection (a) is a misdemeanor of the first
     6     degree. Any person who is or any corporation which is found
     7     guilty of sponsoring such competition shall be sentenced to
     8     pay a fine of $10,000.
     9         (3)  Any person who participates as a contestant in any
    10     competition prohibited in subsection (a) commits a
    11     misdemeanor of the first degree.
    12         (4)  For each second and subsequent violation of
    13     subsection (a), the penalties provided in this section shall
    14     be doubled.
    15         (5)  Whenever a corporation is found guilty in paragraph
    16     (1) or (2), the chief executive officer of the corporation
    17     shall be liable for the penalties imposed by the court.
    18     (c)  Definition.--For purposes of this section the phrase
    19  "tough guy contest" or "battle of the brawlers" means any
    20  competition which involves any physical contact bout between two
    21  or more individuals, none of whom has had professional boxing or
    22  wrestling experience nor has trained in the martial arts, who
    23  attempt to knock out their opponent by employing boxing,
    24  wrestling, martial arts tactics, or any combination thereof and
    25  by using techniques including, but not limited to, punches,
    26  kicks and choking. This term shall not apply to amateur or
    27  professional contests of the martial arts and any collegiate or
    28  scholastic boxing, wrestling or martial arts contest.
    29     Section 2.  This act shall take effect in 30 days.
