HOUSE RESOLUTION

        INTRODUCED BY SPENCER, BERSON, WHITE AND McVERRY, JULY 1, 1981

        REFERRED TO COMMITTEE ON RULES, JULY 1, 1981

                           In the House of Representatives, July 1, 1981

     1     WHEREAS, The volume of supplies, services and construction
     2  procured by the Commonwealth has increased many times over since
     3  the adoption of the act of April 9, 1929 (P.L.177, No.175),
     4  known as "The Administrative Code of 1929"; and
     5     WHEREAS, The amount of public funds from both State and
     6  Federal sources, expended for supplies, services and
     7  construction procured by the Commonwealth has similarly
     8  increased; and
     9     WHEREAS, The increased volume of expenditures makes it
    10  fundamental that public funds be spent wisely and in accordance
    11  with procedures that will protect the public treasury from waste
    12  and inefficiency as well as favoritism and corruption; and
    13     WHEREAS, After a five-year effort pursuing these objectives,
    14  the American Bar Association has developed a Model Procurement
    15  Code for State and local governments; and
    16     WHEREAS, The Council of State Governments, the United States
    17  Conference of Mayors and the National Association of Counties

     1  have recommended that their respective members study their own
     2  procurement laws in the light of the Model Procurement Code and
     3  Regulations with a view towards adapting to their own needs any
     4  suitable legislative or regulatory material found therein; and
     5     WHEREAS, The states, cities and counties which have conducted
     6  studies have benefitted substantially as a result of those
     7  studies; and
     8     WHEREAS, The Commonwealth of Pennsylvania could benefit by
     9  the availability of the Model Procurement Code and Regulations
    10  as a basis for improvement of Commonwealth procurement laws,
    11  policies and procedures to achieve their objectives; therefore
    12  be it
    13     RESOLVED, That the Joint State Government Commission be
    14  directed to appoint a task force to conduct, in conjunction with
    15  the Executive Branch and professional organizations, a study of
    16  the Commonwealth's procurement laws, policies, procedures and
    17  compare them to the Model Procurement Code and Regulations with
    18  the objective of identifying all desirable present laws,
    19  policies and procedures and simultaneously identifying those
    20  portions of the Model Procurement Code and Regulations which
    21  would be beneficial and which are adaptable to the needs of the
    22  Commonwealth; and be it further
    23     RESOLVED, That the Joint State Government Commission shall
    24  report the findings of its task force along with recommended
    25  legislation to the General Assembly as  soon as possible.
