In the House of Representatives, May 4, 1981 1 WHEREAS, The Department of Environmental Resources has 2 determined the air in the Borough of West York, York County, to 3 be the dirtiest in the Commonwealth of Pennsylvania; and 4 WHEREAS, The amount of dust in the air of West York has been 5 determined to exceed Federal Environmental Protection Agency 6 guidelines designed to protect human health; and 7 WHEREAS, The air pollution in West York has caused residents 8 with heart and respiratory ailments to suffer breathing 9 difficulties, and has the potential to become a serious health 10 hazard to all residents of West York; and 11 WHEREAS, The air pollution in West York has caused 12 considerable property damage and clean-up expenses to the 13 residents of the area; and 14 WHEREAS, The Department of Environmental Resources has for 15 years attempted but has been unable to abate the air pollution 16 problem of West York; and
1 WHEREAS, All existing legal remedies and channels of handling
2 problems such as this have failed to provide an adequate
3 solution to the pollution in West York; and
4 WHEREAS, Deficiencies in current law which prevent a solution
5 to the air pollution in West York equally deter any solution to
6 similar air pollution problems throughout the Commonwealth;
7 therefore be it
8 RESOLVED, That the Speaker of the House of Representatives
9 appoint a select committee of five members of the House of
10 Representatives, three of whom shall be proposed by the Majority
11 Leader and two of whom shall be from PROPOSED BY the Minority <--
12 LEADER to conduct an investigation into the sources of <--
13 industrial air pollution in the West York area, to review
14 deficiencies in existing law which allow such pollution to
15 continue unimpeded, and to examine procedures which would
16 expedite the resolution of industrial air pollution problems;
17 and be it further
18 RESOLVED, That the committee may hold public hearings, take
19 testimony, and make its study at such places as it deems
20 necessary within this Commonwealth. Each member of the committee
21 shall have power to administer oaths and affirmations to
22 witnesses appearing before the committee; and be it further
23 RESOLVED, That within 30 calendar days after the committee
24 has made its report, the chairman of the committee shall cause a
25 record of all expenses incurred by the committee, or the members
26 thereof, which are payable at Commonwealth expense, to be filed
27 with the Speaker of the House and the Speaker shall cause the
28 same to be entered in the journal thereof. No expenses incurred
29 by the committee or any member thereof shall be reimbursable by
30 the Chief Clerk unless such expenses shall first have been

1 included as an expense item in the record heretofore required; 2 and be it further 3 RESOLVED, That the committee make a report of its findings 4 and recommendations for remedial legislation as soon as possible 5 to the House of Representatives. D29L82DGS/19810H0063R1574 - 3 -
