AN ACT 1 Amending the act of May 6, 1968 (P.L.117, No.61), entitled, as 2 amended, "An act providing for grants to be made by the 3 Commonwealth for the construction, rehabilitation, 4 alteration, expansion, or improvement of certain site 5 development facilities and assistance in the acquisition of 6 land located in designated impoverished urban areas; imposing 7 duties and powers on the Secretary of Commerce and the 8 Department of Commerce; and making an appropriation," 9 providing for economically distressed counties and 10 communities and department regulations. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. The act of May 6, 1968 (P.L.117, No.61), known as 14 the "Site Development Act," is amended by adding a section to 15 read: 16 Section 4.1. Economically Distressed Counties, Economically 17 Distressed Communities.--In the case of applications from 18 economically distressed counties or economically distressed 19 communities as defined by department regulations, the amount of 20 any project grant made under the authority of section 3 shall 21 not exceed one hundred fifty thousand dollars ($150,000). 22 Section 2. Section 5 of the act is amended to read:
1 Section 5. Departmental Regulations.--The secretary is 2 hereby authorized to promulgate necessary rules and regulations, 3 and prescribe conditions and procedures to effectuate the grant 4 program authorized herein, except for rules and regulations 5 which would require a local matching financial contribution 6 representing a percentage of the actual amount of the grant 7 awarded when the applicant is an economically distress county or 8 economically distressed community as defined by department 9 regulations, in order to assure compliance with the stated 10 policy and objectives of this act. In the administration of this 11 program no grant shall be made in connection with any project 12 unless it is determined that the project: 13 (1) Will aid directly in the industrial development or travel 14 development of the community; 15 (2) Is directly related to an industrial or travel 16 development site; 17 (3) Is not inconsistent with an existing development plan for 18 the municipality; 19 (4) Could not otherwise be financed; 20 (5) Will strengthen the income-producing capability of the 21 municipality, and 22 (6) Is necessary to orderly community development. 23 Section 3.
