AN ACT
1 Amending the act of July 30, 1975 (P.L.113, No.57), entitled "An
2 act regulating retail electric suppliers in certain areas,"
3 further providing for the boundaries of the certified
4 territory of retail electric suppliers and further providing
5 for the right and duty to provide retail electric service
6 hereunder.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The definition of "existing distribution line" in
10 section 2, act of July 30, 1975 (P.L.113, No.57), known as the
11 "Retail Electric Supplier Unincorporated Area Certified
12 Territory Act," is amended and a definition is added to read:
13 Section 2. Definitions.--As used in this act:

15 "Existing distribution line" means an electric line of a
16 design voltage of 35,000 volts phase to phase or less which on
17 the effective date of this act (i) is located in an
18 unincorporated area; [and] (ii) is being or has been
19 substantially used for retail electric service; and (iii) has
20 not been used as a subtransmission line.

2 "Subtransmission line" means an electric line which extends
3 from a terminus at or interconnection with a substation to its
4 next most proximate terminus at or interconnection with a
5 substation and which on the effective date of this act did not
6 provide electric service to consumers for ultimate consumption
7 through a direct transformation of voltage other than the
8 transformation of voltage at the substations to which it is
9 interconnected.

11 Section 2. This act shall take effect immediately and shall
12 be retroactive to July 30, 1975; provided however, that a retail
13 electric supplier which is providing service to a consumer from
14 a subtransmission line in accordance with a commission order
15 issued prior to the effective date hereof, shall continue to
16 render such service.
