                                     AN ACT

     1  Amending the act of May 3, 1933 (P.L.242, No.86), entitled, as
     2     amended, "An act to promote the public health and safety by
     3     providing for examination and registration of those who
     4     desire to engage in the occupation of beauty culture;
     5     defining beauty culture, and regulating beauty culture shops,
     6     schools, students, apprentices, teachers, managers and
     7     operators; conferring powers and duties upon the Commissioner
     8     of Professional and Occupational Affairs in the Department of
     9     State; providing for appeals to certain courts by applicants
    10     and licensees; and providing penalties," further providing
    11     for the conducting of examinations.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 12, act of May 3, 1933 (P.L.242, No.86),
    15  referred to as the Beauty Culture Law, amended May 12, 1949
    16  (P.L.1285, No.382), is amended to read:
    17     Section 12.  Examinations; Issuance of Certificates of
    18  Registration.--If the board finds that the applicant has
    19  submitted the credentials required by this act for admission to
    20  examination, and has paid the registration fee required by this
    21  act, the board shall admit such applicant to examination and the


     1  department shall issue a certificate of registration to practice
     2  as operator, manager, or teacher as the case may be to those
     3  successfully passing the required examinations: Provided, That
     4  if the applicant fails to pass the examination he or she may be
     5  eligible to take the next examination without any additional
     6  fee. Every certificate of registration issued by the department
     7  shall have attached securely thereto a photograph of the person
     8  to whom the same is issued, and where a certificate is issued in
     9  the name of a corporation it shall have attached thereto the
    10  photograph of the manager thereof. Such photographs shall be
    11  furnished by the applicant for registration and shall be of such
    12  size as the board may require. The board shall hold public
    13  examinations on the third Tuesday in January, April, July, and
    14  October in the cities of Philadelphia, Pittsburgh, Wilkes-Barre,
    15  Harrisburg, and Erie at such hours as it shall prescribe. The
    16  examination for teachers' and managers' licenses shall differ
    17  from the examination for operators' licenses in that it shall be
    18  of a more exacting nature and require higher standards of
    19  knowledge of the practice and theories of beauty culture,
    20  including ability to teach properly the various practices and
    21  theories of beauty culture. In all cases, one board member shall
    22  be present at each examination center to administer the
    23  practical examination for all applicants.
    24     Section 2.  This act shall take effect in 30 days.
