AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for the 4 reimbursement allowable for certain prescribed medications to 5 those authorized to fill them and adding to the duties of the 6 Department of Welfare. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The act of June 13, 1967 (P.L.31, No.21), known 10 as the "Public Welfare Code," is amended by adding a section to 11 read: 12 Section 475. Fees for Pharmacy Providers.--(a) For 13 prescribed medications, a licensed community pharmacy's 14 reimbursement shall be the cost of the drug plus at least a two 15 dollar and seventy-five cents ($2.75) fee of which twenty-five 16 cents (25¢) shall be designated for the specific reimbursement 17 of administrative costs incurred by the pharmacy in its 18 participation as a provider in the Pharmaceutical Services 19 Program under Medicaid or the pharmacy's usual and customary
1 charge to the general public plus twenty-five cents (25¢) 2 designated for the specific reimbursement of administrative 3 costs incurred by the pharmacy in its participation as a 4 provider in the Pharmaceutical Services Program under Medicaid, 5 whichever is lower. 6 (b) For prescribed medications, a licensed hospital or 7 skilled nursing facility or each immediate care facility 8 licensed pharmacy's reimbursement shall be the cost of the drug, 9 plus at least a two dollar and ten cents ($2.10) fee or that 10 pharmacy's usual and customary charge to the general public, 11 whichever is lower. 12 (c) The department shall annually review the cost of filling 13 prescriptions and the specific administrative costs incurred by 14 pharmacies in their participation as providers in the 15 Pharmaceutical Services Program under Medicaid. 16 (d) The department shall be empowered to effect 17 Pharmaceutical Services Program cost reductions sufficient to 18 offset the increased costs of the proposed pharmacy provider fee 19 increases through the limitation or elimination of reimbursement 20 for nonlegend (over the counter) drug preparations. 21 Section 2.
