AN ACT 1 Amending the act of June 3, 1937 (P.L.1225, No.316), entitled 2 "An act concerning game and other wild birds and wild 3 animals; and amending, revising, consolidating, and changing 4 the law relating thereto," authorizing free licenses to be 5 issued to residents sixty-five years of age or older, 6 providing for reimbursement of lost revenue, and making an 7 appropriation. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 302, act of June 3, 1937 (P.L.1225, 11 No.316), known as "The Game Law," amended October 21, 1975 12 (P.L.431, No.122), is amended to read: 13 Section 302. Resident License Fees.--Each such resident as 14 defined in sections 101 and 301, upon application made, in 15 writing, to an agent authorized to issue such licenses within 16 the Commonwealth, and upon presentation of proof by the 17 applicant that he or she is a resident of this Commonwealth as 18 previously defined in this act by producing a current 19 Pennsylvania motor vehicle registration card, or tax receipts
1 evidencing payment of State income tax, earned income tax or 2 other local taxes pursuant to the act of December 31, 1965 3 (P.L.1257, No.511), known as "The Local Tax Enabling Act," or 4 some other positive means of verifying residency, and the 5 establishment of his or her identity to the satisfaction of the 6 authority issuing the license, unless any such person has been 7 disqualified for a license in the manner hereinafter specified, 8 and the payment to said agent or the commission of eight dollars 9 and twenty-five cents ($8.25) except as hereinafter provided for 10 certain minors and [older] persons sixty-five years of age or 11 older, shall be entitled to a resident hunter's license and a 12 tag with the number of the license thereon, which shall entitle 13 the holder to hunt or trap for all wild birds and wild animals 14 which may legally be hunted or trapped in this Commonwealth. 15 Residents with the above qualifications, who are between the 16 ages of twelve and sixteen inclusive [or who are sixty-five 17 years of age or more] at the time of application, shall be 18 entitled to a resident hunter's license and tag upon payment to 19 said agent or the commission of, [in the case of persons sixty- 20 five years of age or more, five dollars and twenty-five cents 21 ($5.25) and,] in the case of persons between the ages of twelve 22 and sixteen, five dollars and twenty-five cents ($5.25). The 23 application for the issuance of a license in such cases shall, 24 in addition to the other information required, give the date of 25 birth of the applicant. Residents with the above qualifications, 26 who are sixty-five or more years of age at the time of 27 application, shall be entitled to a resident hunter's license 28 free of charge except in the event that the license is issued by 29 an issuing agent, when a fee of twenty cents (20¢) for the use 30 of the issuing agent shall be collected. 19810H0510B0537 - 2 -
1 Any resident disabled veteran of any war whose disability 2 consists of the loss of one or more limbs or the loss of the use 3 of one or more limbs, or who presents a physician's certificate 4 of total or one hundred per cent disability, and who meets the 5 above qualifications shall be issued such license upon 6 application to any county treasurer without the payment of the 7 above license fee provided for the use of the Commonwealth. The 8 application for the issuance of a license in such case shall in 9 addition to the other information required, contain a statement 10 that the applicant is a war veteran and that his disability was 11 service incurred. The county treasurer may likewise require of 12 such applicant the production of such applicant's discharge 13 papers. The General Assembly shall in each fiscal year beginning 14 on or after July 1, 1977, annually appropriate to the commission 15 a sum derived from multiplying five dollars ($5.00) times the 16 number of free senior citizen licenses issued the previous 17 fiscal year for payment of the loss in license fees occasioned 18 by issuance of free licenses to senior citizens. 19 Section 2. The sum of two hundred thousand dollars 20 ($200,000), or as much thereof as may be necessary, for the 21 fiscal year beginning July 1, 1981 until June 30, 1982 is hereby 22 appropriated to the Pennsylvania Game Commission for payment of 23 the loss in license fees provided by this amending act. 24 Section 3.
