                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, authorizing farm truck plates for buses used
     3     primarily for agricultural purposes, further providing for
     4     the operation of agricultural vehicles on certain highways
     5     and for the maintenance of certain highways.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1344 of Title 75, act of November 25,
     9  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
    10  Statutes, is amended to read:
    11  § 1344.  Use of farm truck plates.
    12     (a)  General rule.--A truck bearing farm truck registration
    13  plates shall be used exclusively upon a farm or farms owned or
    14  operated by the registrant of the vehicle or upon highways
    15  between:
    16         (1)  Parts of one such farm.
    17         (2)  Such farms.
    18         (3)  Such a farm or farms and a place of business for the
    19     purpose of buying or selling agricultural commodities or

     1     supplies or for the inspection, repair or servicing of the
     2     vehicle.
     3     (b)  Buses.--A bus used primarily for agricultural purposes,
     4  and in accordance with subsection (a), shall be eligible for
     5  registration as a farm truck and to bear farm truck plates.
     6     [(b)] (c)  Penalty.--Any person violating this section is
     7  guilty of a summary offense and shall, upon conviction, be
     8  sentenced to pay a fine of $50 and shall, upon conviction for a
     9  second or subsequent offense, be sentenced to pay a fine of
    10  $200.
    11     Section 2.  Vehicles engaged in the local pickup and delivery
    12  of agricultural commodities may use State secondary roads
    13  regardless of the posted weight limit.
    14     Section 3.  The Commonwealth shall, within a ten-mile radius
    15  of all agricultural processing plants, maintain those State
    16  highways for which it has maintenance responsibility, in a
    17  condition which will accommodate the maximum truck weight limit.
    18     Section 4.  This act shall take effect immediately.
