                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to convey to the Scranton
     3     Primary Health Care Center, Inc., a certain parcel of land
     4     together with a building erected thereon, situate in the City
     5     of Scranton, County of Lackawanna, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Governor, is hereby authorized and directed on
    10  behalf of the Commonwealth of Pennsylvania, to grant and convey
    11  to the Scranton Primary Health Care Center, Inc., the following
    12  tract of land, together with a building erected thereon, bounded
    13  and described as follows:
    14     All that certain lot, piece or parcel of land, situate in the
    15  City of Scranton, County of Lackawanna and Commonwealth of
    16  Pennsylvania, described as follows, viz:
    17     Lots Number Twenty-three (23) and Twenty-four (24) in Square
    18  or Block Number Two Hundred Twenty-six (226) and situate upon
    19  street called and known as Wyoming Avenue upon the plot of
    20  Scranton, intended to be duly registered and recorded, said lots

     1  being together eighty (80) feet in front and one hundred sixty-
     2  seven (167) feet in depth; and rectangular with an alley in the
     3  rear sixteen (16) feet wide for public use, and with the
     4  privilege of using ten (10) feet in front of the front line of
     5  said lots on Wyoming Avenue and Ash Street for door, yard,
     6  vault, piazza, porch or bay window, but for no other purpose;
     7  the top line of said vault in no case to be higher than the top
     8  of the sidewalk.
     9     Together with the right of surface support acquired by deed
    10  of the Scranton Trust Company to the School District of the City
    11  of Scranton, dated August 28, 1917 and recorded in Lackawanna
    12  County in Deed Book Volume 280, at Page 271.
    13     Being the same premises conveyed to the Commonwealth of
    14  Pennsylvania by deed dated October 25, 1954 by the School
    15  District of the City of Scranton, recorded in Lackawanna County
    16  Recorder of Deeds Office in Deed Book Volume 528, at Page 193.
    17     And being the same premises conveyed to the City of Scranton
    18  School District by deed of the Lackawanna Iron and Coal Company,
    19  dated May 1, 1882 and recorded in Lackawanna County in Deed Book
    20  Volume 11, at Page 494.
    21     Together with all and singular the improvements, ways,
    22  waters, water courses, rights, privileges, hereditaments and
    23  appurtenances whatsoever thereunto belonging, or in anywise
    24  appertaining, and the reversions and remainders, rents, issues
    25  and profits thereof; and all the estate, right, title, interest,
    26  property, claim and demand whatsoever of the Commonwealth of
    27  Pennsylvania in law, equity or otherwise howsoever of, in and to
    28  the same and every part thereof.
    29     The conveyance shall be made under and subject to all
    30  easements, servitudes and rights of others, including but not

     1  confined to streets, roadways, and rights of any telephone,
     2  telegraph, water, electric, sewer, gas or pipeline companies, as
     3  well as under and subject to any interest, estates or tenancies
     4  vested in third persons, whether or not appearing of record, for
     5  any portion of the land or improvements erected thereon.
     6     Section 2.  The deed of conveyance for the property described
     7  in section 1 shall contain a clause that the lands conveyed
     8  shall be used for health care purposes by the Scranton Primary
     9  Health Care Center and if at any time the said Scranton Primary
    10  Health Care Center or its successor in function conveys said
    11  property or authorizes or permits said property to be used for
    12  any purpose other than health care purposes, the title thereto
    13  shall immediately revert to and revest in the Commonwealth of
    14  Pennsylvania.
    15     Section 3.  The deed of conveyance for the property described
    16  in section 1 shall be approved by the Department of Justice and
    17  shall be executed by the Secretary of the Department of General
    18  Services in the name of the Commonwealth of Pennsylvania.
    19     Section 4.  This act shall take effect immediately.
