AN ACT 1 Amending the act of April 14, 1937 (P.L.313, No.87), entitled, 2 as amended, "An act to enable cities of the first, second, 3 and second class A, incorporated towns, boroughs, and 4 townships, to govern and regulate by ordinance the 5 construction, alteration, repairs, occupation, maintenance, 6 sanitation, lighting, ventilation, water supply, toilet 7 facilities, drainage, use and inspection of all buildings and 8 housing and land appurtenant thereto; providing for the 9 enforcement of such ordinances; and repealing existing laws," 10 providing for referendums in those wards of cities of the 11 second class wherein it is proposed to construct or renovate 12 a building for use as a multi-family dwelling of twenty-five 13 or more units. 14 The General Assembly of the Commonwealth of Pennsylvania 15 hereby enacts as follows: 16 Section 1. The act of April 14, 1937 (P.L.313, No.87), 17 entitled, as amended, "An act to enable cities of the first, 18 second, and second class A, incorporated towns, boroughs, and 19 townships, to govern and regulate by ordinance the construction, 20 alteration, repairs, occupation, maintenance, sanitation, 21 lighting, ventilation, water supply, toilet facilities, 22 drainage, use and inspection of all buildings and housing and 23 land appurtenant thereto; providing for the enforcement of such
1 ordinances; and repealing existing laws," is amended by adding a 2 section to read: 3 Section 2.1. (a) Any person, firm or corporation, who 4 proposes to construct or convert a building to serve as a multi- 5 family dwelling of twenty-five (25) or more units in a city of 6 the second class, shall notify the governing body of the city at 7 least six (6) months prior to such construction or conversion. 8 (b) Upon receipt of such notice, the governing body of the 9 city shall, at the next primary, municipal or general election, 10 schedule a referendum on the question to be held in the ward or 11 wards encompassing the proposed project. The referendum shall be 12 advertised in at least two (2) newspapers of general circulation 13 within the city and shall be conducted in accordance with the 14 act of June 3, 1937 (P.L.1333, No.320), known as the 15 "Pennsylvania Election Code." 16 (c) The question on the ballot shall be phrased in 17 substantially the following form: 18 "Shall the building proposed to be constructed 19 (converted) for use as a multi-family dwelling located 20 at .......................... in the .......... ward(s) 21 of the City of ........................... be so 22 constructed (converted)?" 23 (d) Unless a majority of the electors voting on the question 24 vote in the affirmative, the proposed project shall be 25 disapproved and shall not be carried out. 26 (e) Nothing in this section shall be construed to repeal or 27 affect any law or ordinance relating to the construction or 28 renovation of buildings. 29 Section 2.
