AN ACT 1 Amending Title 66 (Public Utilities) of the Pennsylvania 2 Consolidated Statutes, providing for the use of certain 3 Federal appropriations FUNDS. <-- 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 66, act of November 25, 1970 (P.L.707, 7 No.230), known as the Pennsylvania Consolidated Statutes, is 8 amended by adding a section to read: 9 § 511.1. Certain Federal appropriations. <-- 10 (a) Use of funds.--The commission is authorized to apply for 11 and subject to legislative appropriation use Federal funds 12 pursuant to the National Energy Act which is composed of: 13 (1) the "National Energy Conservation Policy Act," 14 Public Law 95-619; 15 (2) the "Powerplant and Industrial Fuel Use Act of 16 1978," Public Law 95-620; 17 (3) the "Public Utility Regulatory Policies Act of
1 1978," Public Law 95-617; 2 (4) the "Natural Gas Policy Act of 1978," Public Law 95- 3 621; 4 (5) the "Energy Tax Act of 1978," Public Law 95-618; 5 (6) the "Energy Conservation and Production Act of 6 1976," Public Law 94-385; and 7 (7) any future Federal legislation or amendments to the 8 above providing special funds for: 9 (i) rate-making research and development; 10 (ii) energy conservation research and development; 11 (iii) motor carrier and rail transportation safety 12 programs; 13 (iv) gas safety programs. 14 (b) Nonlapsing funds.--Any funds the commission receives 15 pursuant to subsection (a) shall not be subject to lapsing at 16 the end of any fiscal period. 17 (c) Exemption from reimbursement.--No funds under this 18 section shall be reimbursed to any utility. 19 § 511.1. USE OF FEDERAL FUNDS UNDER ENERGY PROGRAM. <-- 20 (A) GENERAL RULE.--THE COMMISSION IS AUTHORIZED TO APPLY FOR 21 AND, SUBJECT TO APPROPRIATION BY THE GENERAL ASSEMBLY, USE 22 FEDERAL FUNDS PURSUANT TO THE NATIONAL ENERGY ACT WHICH IS 23 COMPOSED OF: 24 (1) THE "NATIONAL ENERGY CONSERVATION POLICY ACT," 25 PUBLIC LAW 95-619. 26 (2) THE "POWERPLANT AND INDUSTRIAL FUEL USE ACT OF 27 1978," PUBLIC LAW 95-620. 28 (3) THE "PUBLIC UTILITY REGULATORY POLICIES ACT OF 29 1978," PUBLIC LAW 95-617. 30 (4) THE "NATURAL GAS POLICY ACT OF 1978," PUBLIC LAW 95- 19790H1787B2634 - 2 -
1 621. 2 (5) THE "ENERGY TAX ACT OF 1978," PUBLIC LAW 95-618. 3 (6) THE "ENERGY CONSERVATION AND PRODUCTION ACT OF 4 1976," PUBLIC LAW 94-385. 5 (7) ANY FUTURE FEDERAL LEGISLATION OR AMENDMENTS TO THE 6 STATUTES LISTED IN THIS SUBSECTION PROVIDING SPECIAL FUNDS 7 FOR: 8 (I) RATE MAKING RESEARCH AND DEVELOPMENT. 9 (II) ENERGY CONSERVATION RESEARCH AND DEVELOPMENT. 10 (III) MOTOR CARRIER AND RAIL TRANSPORTATION SAFETY 11 PROGRAMS. 12 (IV) GAS SAFETY PROGRAMS. 13 (B) FUNDS NOT SUBJECT TO LAPSE.--FUNDS RECEIVED BY THE 14 COMMISSION PURSUANT TO SUBSECTION (A) SHALL NOT BE SUBJECT TO 15 LAPSING AT THE END OF ANY FISCAL PERIOD. 16 (C) REIMBURSEMENT TO UTILITIES PROHIBITED.--FUNDS RECEIVED 17 BY THE COMMISSION PURSUANT TO SUBSECTION (A) SHALL NOT BE 18 REIMBURSED TO ANY PUBLIC UTILITY. 19 Section 2.
