        AS REPORTED FROM COMMITTEE ON LOCAL GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 17, 1979

                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," providing
     4     for the signing of certain written contracts and agreements
     5     by the president of the borough council AND CLARIFYING THE     <--
     6     DUTIES OF THE MAYOR.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Clause (3) of section 1006 AND CLAUSE (2) OF       <--
    10  SECTION 1029, act of February 1, 1966 (1965 P.L.1656, No.581),
    11  known as "The Borough Code," is ARE amended to read:              <--
    12     Section 1006.  Duties of Council.--It shall be the duty of
    13  the borough council:

    15     (3)  To enact, revise, repeal and amend such bylaws, rules,
    16  regulations, ordinances and resolutions, not inconsistent with
    17  the laws of the Commonwealth, as it shall deem beneficial to the
    18  borough and to provide for the enforcement of the same. The
    19  legislative powers of boroughs including capital expenditures


     1  not payable out of current funds, shall be exercised by or be
     2  based on an ordinance. All other powers shall be exercised by
     3  vote of the majority of council present at a meeting, unless
     4  otherwise provided. Routine, ministerial or administrative
     5  purchases and powers may be made and exercised by officers or
     6  committees, if authority therefor was previously given, or if
     7  the action is subsequently ratified by council. Whenever any
     8  action by the council shall result in a specific written
     9  contract or agreement, such contract or agreement shall be
    10  signed by the president of the borough council.

    12     SECTION 1029.  DUTIES OF MAYOR.--IT SHALL BE THE DUTY OF THE   <--

    15     (2)  [TO] EXCEPT AS PROVIDED IN SECTION 1006(3), TO SIGN SUCH  <--
    16  PAPERS, CONTRACTS, OBLIGATIONS AND DOCUMENTS AS MAY BE REQUIRED
    17  BY LAW.

    19     Section 2.  This act shall take effect in 60 days.
