AN ACT 1 To provide pharmaceutical assistance to the aged. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. Short title. 5 This act shall be known and may be cited as the 6 "Pharmaceutical Assistance to the Aged Act." 7 Section 2. Program established. 8 The program of "Pharmaceutical Assistance to the Aged" is 9 hereby established and shall consist of payments to pharmacies 10 for the reasonable cost of prescription drugs of eligible 11 persons, which exceed a $1 copayment per prescription or per 12 purchase of insulin, paid by each eligible person. For purposes 13 of this act, "prescription drugs" means all legend drugs, 14 insulin, insulin syringes and insulin needles, "reasonable cost" 15 means the cost of prescription drugs plus a dispensing fee, as 16 determined by the secretary and "secretary" means the Secretary 17 of Revenue.
1 Section 3. Eligibilities. 2 (a) Every resident of Pennsylvania who is 65 years of age or 3 older and whose annual family income from all sources is less 4 than $7,500 shall be eligible. 5 (b) Any otherwise eligible person whose prescription drug 6 costs are wholly covered by any other plan of assistance or 7 insurance shall be ineligible for assistance under the 8 provisions of this act. Any otherwise eligible person whose 9 prescription drug costs are covered in part by any other plan of 10 assistance or insurance may be required to receive reduced 11 assistance under the provisions of this act. 12 Section 4. Payments. 13 The secretary shall by regulation establish a system of 14 payments or reimbursements and a system for determining 15 eligibility, including provisions for submission of proof of 16 actual and anticipated annual income, and evidence of complete 17 or partial coverage or prescription drug costs by any other 18 assistance or insurance plans. 19 Section 5.
