                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, redefining parts of the offense of
     3     criminal trespass.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Subsection (a) of section 3503 of Title 18, act
     7  of November 25, 1970 (P.L.707, No.230), known as the
     8  Pennsylvania Consolidated Statutes, is amended to read:
     9  § 3503.  Criminal trespass.
    10     (a)  Buildings and occupied structures.--
    11         (1)  A person commits an offense if, knowing that he is
    12     not licensed or privileged to do so, he [enters or gains
    13     entrance by subterfuge or surreptitiously remains in any
    14     building or occupied structure, or separately secured or
    15     occupied portion thereof.]:
    16             (i)  enters, gains entry by subterfuge or
    17         surreptitiously remains in any building or occupied
    18         structure or separately secured or occupied portion


     1         thereof; or
     2             (ii)  breaks into any building or occupied structure
     3         or separately secured or occupied portion thereof.
     4         (2)  [An offense under this subsection is a felony of the
     5     second degree.] An offense under subparagraph (i) of
     6     paragraph (1) is a misdemeanor of the second degree, and an
     7     offense under subparagraph (ii) is a felony of the second      <--

     9         (3)  As used in this subsection:
    10         "Breaks into." To gain entry by force, breaking,
    11     intimidation, unauthorized opening of locks, or through an
    12     opening not designed for human access.
