AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," requiring full State funding for all 6 mandated State educational programs and activities. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known 10 as the "Public School Code of 1949," is amended by adding a 11 section to read: 12 Section 2554. State Funding for State Mandated Educational 13 Programs and Activities.--(a) No school district shall be 14 required to develop, implement, and administer any new State 15 mandated educational program or State mandated educational 16 activity until such time as the school district shall receive 17 from the Commonwealth of Pennsylvania the full amount of money 18 necessary to develop, implement and administer the State 19 mandated program or activity. 20 (b) After the passage of one year from the effective date of
1 this amendatory act, no school district shall be required to 2 continue and administer any State mandated educational program 3 or State mandated educational activity until such time as the 4 school district shall receive from the Commonwealth of 5 Pennsylvania the full amount of money necessary to continue and 6 administer any State mandated educational program or activity. 7 (c) For purposes of this section the term: 8 (1) "Full amount of money" means money from the General Fund 9 which is appropriated in an amount sufficient to cover all costs 10 involved in the development, implementation and administration 11 of any State mandated program or activity. Such moneys shall be 12 in addition to any other moneys the district is entitled to. 13 (2) "State mandated program or activity" means any program 14 or activity which is imposed without choice on all or a portion 15 of all local school districts by acts of the General Assembly or 16 by regulations and policies of the Department of Education. 17 Section 2. This act shall take effect in 60 days. Section 18 2554(a) shall apply to all programs mandated after the effective 19 date of this act and section 2554(b) shall apply to all mandated 20 programs.
